YAUKEY # OS" - /9oJ......... GUlL ~8L~ Defendants COMPLAINT IN MORTGAGE FORECLOSURE I. Plaintiff, Patriot Federal Credit Union, of 800 Wayne Avenue, Chambersburg, Pennsylvania, brings this action to foreclose a mortgage dated June II, 1998, between Dennis F. Yaukeyand Gloria J. Yaukey, Mortgagors, and Patriot Federal Credit Union, Mortgagee, which is recorded in Cumberland County Mortgage Book Volume 1461, Page 790, a copy of said mortgage executed by Defendants is attached hereto and made a part hereof as Exhibit "A". 2. The land subject to the mortgage is situate in Hopewell Township, Cumberland County, Pennsylvania, conveyed to Defendants by deed of Eugene S. Dunlap, dated February 18, 1971, and recorded in Cumberland County Deed Book V o\ume Z23, Page 47, a copy of which deed is attached hereto and made a part hereof as Exhibit "B". 3. The mortgage has not been assigned. 4. Defendants are the real owners of the land subject to the mortgage and their address is 32 Jumper Road, Shippensburg, PA 17257. 5. The mortgage is in default because Defendants have failed to make payments upon the Mortgage. Notices of default in the form of Act 91 were delivered to Defendants by first class mail with proof of mailing and certified mail dated February 24, 2005, and receipted by Defendants on February 25, 2005. Copies of the Notices and mailing receipts are attached hereto, made a part hereof and marked Exhibit "C". 6. The following amounts are due on the mortgage: a. b. Principal and interest Attorney's collection fee Total $36,616.47 5.492.47 $42,108.94 WHEREFORE, Plaintiff prays the court to enter judgment in mortgage foreclosure in the monetary sum of $42, 108.94 together with costs and interest at the contract rate after judgment.
