Bradley L. Griffie, Esquire, and the law firm of Griffie & Associates, P:��., and pe�ions �
the Court as follows:
1. Your Petitioner is the Administratrix of the above referenced estate, having
been so appointed by the Register of Wills of the Court of Common Pleas of
Cumberland County, Pennsylvania, by the issuance of a Certificate of Grant of
Letters Administration dated May 31, 2013.
2. The decedent herein passed away on May 4, 2013 without a Last Will and
Testament.
3. The decedent was the 33 year old son of your Petitioner, the Administratrix of
this estate.
4. The decedent's other parent, Joseph O. Railing, Jr., renounced his right to serve
as Administrator of this estate in favor of the decedent's mother, your Petitioner
herein.
5. At the time of his passing, the decedent owned real estate located at 519 North
Bedford Street, Carlisle, Cumberland County, Pennsylvania, as evidenced by
the Deed recorded in the Office of the Recorder of Deeds in Deed Book 272,
Page 641, a copy of which Deed is attached hereto and incorporated herein as
Exhibit"A".
6. The aforesaid real estate, which was owned in the decedent's name alone, was
encumbered with a mortgage due and owing to Sovereign Bank, N.A., of P.O.
Box 12649, Reading, Pennsylvania, 19612-2649.
7. At the time of his passing, the decedent's real estate was encumbered with a
second mortgage due and owing to Ocwen Loan Servicing, LLC, of PO Box
780, Waterloo, Iowa, 50704-0780.
8. The approximately balance that was due on the two mortgages just after the
decedent's passing was $112,341.33 for Sovereign Bank, N.A. and $23,520.79
for Ocwen Loan Servicing, LLC.
9. In the Mortgage foreclosure documents filed by Sovereign Bank, N.A., the
balance claimed to be due on that Mortgage as of January 24, 2014 is
$119,829.15.
10. The instant estate is insolvent, as more fully identified on the copy of the
Inheritance Tax Return attached hereto and incorporated herein by reference as
Exhibit"B", said Return having been filed of record with the Register of Wills.
11. Your Petitioner herein made efforts to sell the real estate at issue located at 519
North Bedford Street, Carlisle, Cumberland County, Pennsylvania, through the
services of Dennis Eckman, Realtor, of Hooke, Hooke & Eckman Realtors, 977
Walnut Bottom Road, Carlisle, Pennsylvania, 17015, by listing the property at
the recommended price of$127,900.00 on or about June 11, 2013.
12. On or about six weeks following the listing of the property, as there was no
indication of any interest in the home by third party purchasers at that value, and
upon the recommendation of the selected realtor, the listing price of the property
was reduced to $119,500.00.
13. Despite the reduction in the listing price, there was, again, no interest shown in
purchasing the home by any third parties through the listing realtor.
14. To secure a better perspective of the actual value of the real estate involved, and
following extensive discussions with the listing realtor, the listing realtor
provided a Comparative Market Analysis setting the value of the property in the
range of $74,900.00 to $89,900.00, a copy of said current Market Analysis
being attached hereto and incorporated herein as Exhibit"C".
15. Pending the sale of the real estate, your Petitioner was obligated to pay from this
insolvent estate, fees associated with maintaining utilities, including gas,
electric, and water and sewer on the real estate, so that the property could be
properly maintained and shown as it was listed for sale.
16. Due to the insolvency of the estate, the lack of any interest whatsoever at any
reasonable listing price for the sale of the property, and the fact that the last
listed price of the property was insufficient to pay the balance of the first
mortgage, even without consideration of the second mortgage that exceeded
$24,000.00, your Petitioner and counsel determined that any further efforts at
sale of the property would be an additional waste of the limited resources
available to this insolvent estate and Administratrix.
17. By correspondence in September of 2013, Petitioner, through counsel, notified
the first and second mortgage holders that the estate was unable to pay any
additional utility expenses for the property, that no additional marketing efforts
would be made and that if either of the mortgage companies wished to use the
services of the listing realtor, they were welcome to do so, but under no
circumstances could the estate, or appropriately any third parties such as the
Administratrix, expend any more sums attempting to maintain the property
pending a sale that would not produce sufficient funds to pay even the first
mortgage on the property.
18. Pursuant to 20 Pa.C.S. Section 3312, your Petitioner is authorized to petition the
Court and request authorization to renounce her right to administer property
which is of no value to the estate.
19. The instant real estate was not only of no value to the estate, but also was of no
value to the decedent at the time of his passing as it was encumbered well in
excess of its reasonable value, based upon Petitioner's efforts to market and sell
the property immediately after decedent's death.
20. Both of the mortgage holders herein have been advised of the position of the
estate and notified that the foreclosure on the property will need to take place as
a Deed in Lieu of Foreclosure is not an available alternative under
circumstances where there are two mortgage holders.
21. Even without circumstances of the mortgages on the real estate being more than
$25,000.00 in excess of the value of the property, the estate is� otherwise
insolvent based upon its limited assets and its substantial debt.
22. Joseph O. Railing, Jr., the only other beneficiary of the estate other than
Petitioner, concurs in this request.
WHEREFORE, Petitioner requests your Honorable Court to issue a Rule and Citation
upon Santander and Ocwen Mortgage Services, LLC to show cause, if any they have, as
to why the Court should not authorize the personal representative to renounce her right to
administer the property located at 519 North Bedford Street, Carlisle, Cumberland
County, Pennsylvania, as property of the estate, forfeiting any rights or benefits in the
real estate and avoiding any additional liability associated with the real estate such as a
deficiency judgment, thereby, allow the mortgage holders to assume all responsibilities
relative to the real estate.

For dates of death on or after July 1, 1994 and before Jan. 1, 1995,the tax rate imposed on the net value of transfers to or for the use of the surviving
spouse is 3 percent[72 P.S.§9116(a)(1.1)(i)].
For dates of death on or after January 1, 1995,the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0 percent
[72 P.S.§9116(a)(1.1)(ii)). The statute does not exempt a transfer to a surviving spouse from tax,and the statutory requirements for disclosure of
assets and filing a tax return are still applicable even if the surviving spouse is the only beneficiary.

The purpose of this CMA (Comparative Market Analysis) is to recommend a listing price
value of 519 N. Bedford St Carlisle PA 17013 based on its current condition and the current
market.
It is my opinion that the listing price because of its condition and the needed repairs of
busted water pipes, fallen drywall and the realistic expectation of mold remediation is in the
range of$39,900 and $49,900. With the repairs being completed the listing price would be
somewhere in the range of$74,900 to $89,900.
This CMA is not be used for any other purpose than the potential listing value of the property
for sale in its current condition.
