BACKGROUND 1. Dagmar Johnson("Decedent")died April 10, 2014, leaving a Will dated January 9, 1998. 2. Letters Testamentary under the Will were issued to Executrix. 3. Beneficiary is the sole residuary beneficiary of the Decedent's estate. 4. Executrix has proceeded with the administration of the estate, has paid all of the specific and pecuniary bequests set forth in the Will, and has prepared and filed a Pennsylvania Inheritance T�Return which has been accepted by the Pennsylvania Department of Revenue. 5. Executrix has paid all the ta�ces, debts and expenses of the estate known to her, and she has no knowledge of any unpaid claims, absolute or contingent,which may be asserted against the estate, nor does she have any reason to believe there are any such claims, except for any inheritance t�es due on recently discovered savings bonds in the name of the Decedent. 6. Executrix has made distribution of the net assets of the Decedent's estate to the Beneficiary. The parties desire that this Family Settlement Agreement make unnecessary the filing of an accounting in any court. 7. The remaining balance of the estate consists of the recently discovered savings bonds in the name of the Decedent. The Executrix will liquidate the bonds and distribute the proceeds to the Beneficiary as soon as possible. The Executrix will prepare a supplemental {L0450007.1} Inheritance Tax return and pay the additional Inheritance Tax attributable to the bonds. The Executrix, or the Beneficiary, as the case may be, shall pay any income taxes attributable to the bonds. . NOW THEREFORE, intending to be legally bound,the Beneficiary does hereby: 1. Waive the filing of an account of the administration of the esta.te in any court; 2. Declare that she has examined the inheritance tax return and are satisfied with the administration of the estate of Decedent; 3. Warrant that the undersigned knows of no outstanding and unsatisfied claims against the estate; 4. Absolutely and irrevocably release and discharge Executrix, and her heirs, personal representatives, successors and assigns of and from any and all actions, liabilities, claims and demands relating in any way to her administration of the estate and distribution without court accountings and adjudications; 5. Agree to indemnify and hold harmless, Executrix, and her heirs,personal representatives, successors and assigns, from and against any claims, liabilities, loss or expense (including costs and counsel fees) arising from any cause whatsoever,which Executrix may incur as a result of the administration of the estate and distribution in accordance with this agreement including, but not limited to, any liability for any federal estate taxes, Pennsylvania Inheritance tax or any other death t�es, and any federal or Pennsylvania income ta�ces, and Pennsylvania personal property t�es,together with any interest and costs incidental thereto, relating in any way to the estate and also including, but not limited to, any assets received or payments or distributions made by reason of any negligence or mistake of law or fact. 6. Acknowledge that the distributions described in this Agreement are in full satisfaction of all amounts due him or her as a beneficiary of Decedent's estate. _ _ 7. This Agreement may be executed in counterparts, each of which shall be deemed an original, but together shall be treated as the same document.
