PA.C.S.§5511
ORDER OF COURT
AND NOW, this 13th day of October 2014, upon review of the Petition for
Adjudication of Incapacity and Appointment of Plenary Guardian of the Person and
Estate Pursuant to 20 Pa.C.S.§5511, the Court appoints Mark Bayley, Esquire, as
Guardian ad litem for Charles Howe, with compensation to be provided pursuant to 20
Pa.C.S. § 5511(c).
It is hereby ORDERED and DIRECTED that a hearing is scheduled for
11 December 2014 at 1:30 p.m. in Courtroom Number Six of the Cumberland County
Courthouse, Carlisle, Pennsylvania. A CITATION is issued upon Charles Howe to
show reason, if any, why he should not be adjudicated an incapacitated person and why
a successor guardian should not be appointed. Written notice of the petition and
hearing in large type and in simple language shall be given to Charles Howe no less
than twenty (20) days prior to the hearing in accordance with 20 P.S. 5511(a).
Furthermore, the alleged incapacitated person shall be in attendance at the
hearing unless it can be established by his physician that his mental or physical

condition would be harmed by his presence at the hearing. This may be established in
the form of written interrogatories. Alternatively, if available, presence may be done via
two way audio / video conference.
