CIVIL ACTION- MORTGAGE FORECLOSURE
1. Plaintiff is NovaStar Mortgage, Inc. (hereinafter "NovaStar"), a corpo ation
with offices located at 8140 Ward Parkway, #200, Kansas City, MO 64114.
2. Defendants are Frank W. Slyder, JI. and Gretchen E. Slyder, adult indivi uals
with a last-known address of 216 Chestnut Street, Mount Holly Springs, PA 17065.
3. Under date of August 2,2001, defendants executed and delivered to No Sar
a mortgage upon premises 216 Chestnut Street, Mount Holly Springs, PA 17065 to secur the
payment of the sum of $82,400.00. The said mortgage is recorded in the Department of Rec rds
in and for the County of Cumberland in Mortgage Book No. 1735, page 1747, recorded Au ust
9, 2001 and is incorporated herein by reference. A copy of the legal description of the prem ses
is attached hereto and made a part hereof as Exhibit "A".
4. The defendants are the real owners of premises 216 Chestnut Street, Mo nt
Holly Springs, PA 17065.

5. In accordance with Act 91 of 1983, as amended, a combined notice roviding
the information required by ~403 of Act 6 of 1974, and Act 91 aforesaid, was s nt to the
defendants and no response was made in the appropriate period of time. A true and co ect copy
of the aforesaid notice is attached hereto and made a part hereof as Exhibit "B".
6. The said loan is in default as a result of the failure to pay the monthly
installments of $867.08 due on December 1, 2004 and on the 1 st day of each month th reafter.

judgment for foreclosure of the mortgaged property for the sum of $80,728.89, plus in rest
thereon of $3,488.26 plus $22.03 per day from April 7,2005 until judgment is paid in full late
charges of $173.40, plus late charges of $43.35 per month from April 7, 2005until judgm tis
paid in full, escrow advances of $153.77, fees billed of $37.50, recoverable balance of $18 .75,
costs of $300.00, attorney's fees of $4,000.00, plus record costs.
