COMPLAINT
1. Plaintiff is a corporation with oftices located at 20 Stanwix Street, Pittsburgh, P ] 5222
2. Defendant, Christian J. Holland. d/b/a Holland Allstate Insurance Company,
is an adult individual with a last known address of ] 0 Railroad A velllle. Shiremanstown, P A 17 II.
3. On or about April 12,200 I. Defendant, Christian J. Holland. d/b/a Holland Allsta e
Insurance Company, applied for and was granted a revolving line of credit by Plaintifl a true an correct
copy of the Business Line of Credit Agreement, the terms and conditions of which were agreed u on by
the parties, is attached hereto, marked as Exhibit "I ". and made a part hereof.
4. Defendant made use of such credit granted by Plaintiff and has currently a balance ue and
owing to Plaintiff, as of February 15,2005, in the amount of$33,509.71.
5. Defendant defaulted under the tenns ofthe parties' agreement by failing to make th
required payments to Plaintiflwhen due.
6. By the terms of the parties' agreement, Defendant's default made the entire balance fthe
loan immediately due and payable to Plaintiff.
7. Plaintiff avers that the written Agreement between the parties provides that Plaintiff i
entitled to the addition of finance charges at a variable rate.
8. Plaintiff avers that it is entitled to finance charges at the statutory rate of 6.00% per annum
on the unpaid balance.
10. Plaintiff avers that the Agreement between the parties provides that Defendant ill pay
Plaintiffs reasonable attorneys' fees incurred in enforcing said Agreement.
1 L Plaintiff avers that such attorneys' fees amount to $1,500.00.
12. Although repeatedly requested to do so by Plaintiff, Defendant has willfully faile and/or
refused to pay the principal balance, finance charges, late fees, attorneys' fees or any part thereo to
Plaintiff.
WHEREFORE, Plaintiff demands Judgment in its favor and against Defendant Christian J
Holland, d/b/a Holland Allstate Insurance Company, individually in the amount of$33.509.71 w th
continuing attorneys' fees, late fees and finance charges thereon at the rate of 6.00% per annum pI s
costs.
