Bressler, died unexpectedly on October 26, 2008, shortly before he intended to retire. 2. Although he was chronically ill with kidney disease, we had no expectation that his death was imminent. 3. I was aware that the cost of his medical care was significant, although until the time of his death he paid medical expenses from his place of employment and did not bring the receipts home with him. 4. 1 believe that my husband put the medical expenses on credit cards since funds were generally not otherwise available to pay them. 5. At the time of my husband's death, the total of credit card charges in his name alone was $32,443.67, a substantial portion of which related to his medical expenses. 6. There were no assets subject to the probate process at the time of my husband's death, so an estate for my husband was not opened near the time following his death; and I otherwise sought no legal advice at the time of my husband's death in relation the medical expenses and large credit card debt related to his illness. 7. After my husband's death, I became aware of legal action initiated by others against the distributors of Avandia because its use increased the risk of heart problems. 8. On.November 29, 2011, I was notified lawyer from.Texas that a settlement would be forthcoming, but that it would be necessary for me to open an estate before receiving settlement proceeds. 9. I opened an estate on September 10, 2013, and received a check in May 2014. in the amount of$33,365.59 in relation to my husband's estate. 10. In the process of administering the estate, it became evident for the first time that better documentation of the medical expenses which my husband incurred during the last six months of his life would have been relevant. 11. Since the time of my husband's death, I personally assumed or paid $25,847.72 of his credit card obligations, which were substantially related to his medical expenses: Affidavit of Kay E. A Highmark Blue Shield statement dated November 9, 2008, indicates that $5,200 of expenses related to my husband's care during the last three months of his life. 13.
