Plaintiff, Pennsylvania State Employees Credit Union("PSECU"), is a Pennsylvania financial institution having an office at 1500 Elmerton Avenue, Harrisburg, PA 17110. 2. Defendant, Randy S. Zimmerman, is an adult individual with a last known address of 1017 Swarthmore Road, New Cumberland, Pennsylvania 17070-1730. 3. On or about December 14, 2000, Defendant executed and delivered to PSECU a, Note(the"Note") in the original principal sum of$64,600.00. A true and correct copy of the Note is attached hereto as Exhibit"A" and incorporated herein by reference. 10. On or about July 2, 2013, PHFA denied Defendant's application for assistance. A true and correct copy of the denial is attached hereto,made a part hereof and marked as Exhibit 11. On or about July 11, 2013, Plaintiff received notification that Defendant filed an appeal of the PHFA denial decision. A true and correct copy of the appeal notification is attached hereto, made a part hereof as Exhibit"E". 12. On or about October 18, 2013, Plaintiff received notification that the PHFA denial decision had been affirmed. A true and correct copy of the letter affirming PHFA's denial is attached hereto,made a part hereof as Exhibit"F". 13. Pursuant to the Note, in the event of Default, PSECU may, and hereby does, declare all amounts owed under the Note, including principal, accrued interest, late charges, and all other charges, including reasonable attorneys' fees, to be immediately due and payable. 14. Pursuant to the Note, in the event of Default, PSECU is entitled to be reimbursed for all costs and expenses, including reasonable attorneys' fees incurred in bringing any action to enforce the Note. 15. For purposes of this action, PSECU believes, and therefore avers, that$3,000.00 constitutes reasonable attorneys' fees for enforcing the Note. However, PSECU recognizes that it is restricted by law to those attorneys' fees that are actually incurred.
