PARAGRAPH 1. I direct my personal representative to pay all of my.debts and expenses of my last illness and cremation and administrative expenses as soon as conveniently may be done after my decease. It is my wish that all my remains.are cremated and dispersed. PARAGRAPH 2. I give, devise and bequeath the following: a. My jewelry shall be divided in as nearly as.equal shares as possible between my daughters, Leslie.A. Charles of Marysville, Pennsylvania and Cherie L. Haydon of Mechanicsburg, Pennsylvania. In the event that either of my daughters predecease me or fail to survive*me by thirty (30) days, then their share of my jewelry.shall pass to my granddaughter, Jessica J. Charles of Marysville, Pennsylvania. . b. Five Thousand Dollars ($5,000.00) to my step-daughter, Sharon A. Reilly of Mechanicsburg, Pennsylvania. In the event that my step-daughter predeceases me or fails to survive me by thirty (30) days, then the five thousand dollars shall pass to my step-son's son,Anthony Reilly of Wormleysburg, Pennsylvania. PARAGRAPH 3. I then give, devise and bequeath all of the balance of my estate of whatever nature and wherever situate as follows: a. Twenty five percent (25%) to my daughter, Cherie L. Haydon, of Mechanicsburg, Pennsylvania. In the event that my daughter' Cherie L. Haydon predeceases me or fails to survive me by thirty (30) days, I give, devise and bequeath her share to my granddaughter, Jessica J. Charles of Marysville,Pennsylvania. b.. Thirty five percent (35%) to my daughter, Leslie A. Charles. of Marysville, Pennsylvania. In the event that my daughter, Leslie A. Charles predeceases me or fails to survive me by thirty (30) days, I give, devise and bequeath her share of my estate to my granddaughter, Jessica J. Charles of Marysville, Pennsylvania and my grandson, Ryan T. Watts, of Marysville, in as nearly as equal shares as possible, or if one shall predecease me;then all to the survivor. Thomas predeceases me or fails to survive me by thirty (30) days, I give, devise and bequeath his share of my estate to my grandson, Justin J. Thomas of Kingman, Arizona and my grandson, Brandon L. Thomas, of Kingman, Arizona, in as nearly as equal shares as possible, or if one shall predecease me, then all to the survivor. d. Five percent (5%) of my estate to my granddaughter, Jessica J. Charles, Marysville, Pennsylvania. In the event that my granddaughter, Jessica J. Charles predeceases me or fails to survive me by thirty(30) days, I give, devise and bequeath her share of my estate to my grandson, Ryan T. Watts of Marysville, Pennsylvania. PARAGRAPH 4. I direct that all inheritance, estate, transfer, succession and other death taxes imposed,or payable by reason of my death and interest and penalties thereon.with respect to all property composing of my gross estate for death tax purposes, whether or not such property passes under this will or otherwise, shall be paid out of the principal of my residuary estate by my personal representative. PARAGRAPH 5. In addition .to the powers conferred by law, I authorize my personal representative in his or her absolute discretion to compromise claims, borrow money, retain . property for such length of time as he or she.may deem proper; lease and sell property for such prices, on such terms, at public or private sales, as he or-she may deem proper; and invest estate property and income without restriction to legal investments unless otherwise provided hereunder. I authorize and empower my personal representative to sell any realty and/or personalty owned by me at my death and not specifically devised or bequeathed herein, at public or private sale or sales and to give good and sufficient deeds and/or bills of sale therefore, in feesimple, as I could do if living. My personal representative is authorized and empowered to engage in any business. in which I may be engaged at my death, for such period of time after my death as seems expedient to said personal representative. PARAGRAPH 6. Any and all payment or payments of any sum or sums, whether in cash or in kind and whether from principal or income, payable to any beneficiary, shall be made upon the sole receipt of the respective beneficiary. to whom the payment is made and free from anticipation, alienation, assignment, attachment, and pledge, and free from control by the creditors of any such.beneficiary. No beneficiary may assign or anticipate his or her interest in any income or principal held or distributable hereunder; and no beneficiary's creditors may attach or otherwise reach any such interest. PARAGRAPH 7. I nominate and. appoint my brother, Dr. Robert H. McIver, Rochester, New York, Personal Representative of this my Last Will and.Testament. If my brother predeceases me, fails to qualify or is unable to serve for whatever reason, then I appoint my sister-in-law, Dana McIver, Webster, N.Y, to be the Personal Representative of this my Last Will and Testament. No person(s) shall benefit hereunder unless such beneficiary shall survive me by thirty(30) days. PARAGRAPH 9. No Personal Representative or Trustee acting hereunder shall be required to post bond or enter security in this or any other jurisdiction. PARAGRAPH 10. I recommend that my Personal Representative and any successor Personal Representative utilize the services of the Law Offices of Peter J. Russo, P.C. 5006 E. Trindle Road, Suite 100, Mechanicsburg, Pennsylvania 17050 to probate my estate as they have become familiar with my wishes and desires.
