COMPLAINT
NOW COMES, Plaintiff, Capital Credit Corp., and files this complaint pursuant to Pa,
R.C P. No. 295 l(b) for judgment by confession and avers the following:
I, Plaintiff, Capital Credit Corp" is a Pennsylvania Corporation with a principal place of
business address of I 100 York Street, Mechanicsburg, Cumberland County, Pennsylvania
17055,
2, Defendant, is a New York Corporation whose last known address was 2025 Ridge
Road East, Rochester, New York, 14622.
3. A true and correct copy of the original installment note with confession of judgment
executed by the defendant at Plaintiff's principal place of business address and
authorizing warrant of attorney to confess judgment is attached as Exhibit A.
4. The installment note executed by the defendant guarantor promised:
"for value received, _ _ to pay to the order of Capital Credit Corp_.. the principal sum of
$35,724"."
(See, paragraph I of attached Exhibit A)
5 Judgment is not being entered by confession against a natural person in connection with
a consumer credit transaction.
6. The attached original instrument at Exhibit A has not been assigned or transferred.
7, Judgment has not been entered in any jurisdiction on the attached original instrument
at Exhibit A authorizing confession,
8, Defendant JOBA Carfinders, Inc, is indebted to plaintiff in the sum of$32,224 which
amount represents the amount due the plaintiff pursuant to the Agreement signed by the
Defendant dated April 16, 2002.
9. Of said amount, $14,610,00 consists ofa dishonored check issued by JOBA to Capital
Credit and the balance consists of arrearages in the amount of$17,614,00, A true and
correct copy of the dishonored check is attached as Exhibit B and a true and correct copy
of statement of balance due is attached as Exhibit C-
10, Defendant guarantor agreed to attorney fees in an amount equal to 20%, of the unpaid
principal balance, should Defendant default on the installment note (See, paragraph 6 of
attached Exhibit A.)
11. Defendant guarantor waived prior notice and an opportunity to be heard prior to
confessing judgment. (See, paragraphs 5 and 6 of attached Exhibit A.)
12. Notice demanding payment from Defendant guarantor was mailed on December 21,
2004, A true and correct ct copy with attached certified-mail sender's receipt is attached
as Exhibit D.

13. Plaintiff demands judgment as authorized by the warrant of attorney to confess
judgment within paragraph 6 of attached Exhibit A
14, Consequently, the defendant is liable to plaintiff as follows:
Amount of Note: $35,724.00
Stipulated Attorney fee of20% $ 7,144.80
Credit ($3,500.00)
Total: $39,368.80
Plus interest at 20 % per annum on the amount of the note after date of entry of judgment
under the terms of the verified copy of the original note attached at Exhibit A of the
Complaint
WHEREFORE, Plaintiff demands judgment against the Defendant in the sum of
$39,368,80 plus costs of suit as authorized by the warrant of attorney appearing in the
attached verified copy of the instrument at Exhibit A
