MOTION FOR A STATUS CONFERENCE
AND NOW, comes John Maxwell, by and through his attorneys, MARTSON LAW
OFFICES, and in support of his Motion for a Status Conference avers as follows:
1. A Status Conference was held on December 17, 2012.
2. The Honorable Albert H. Masland previously issued Orders in this matter.
3. Parties have completed a round of document discovery, which Petitioner believes
address any outstanding legal questions,placing the action in an ideal posture for the parties to assess
through negotiation the resolution of the claims.
4. Petitioner, John Maxwell, respectfully requests in accordance with Local Rule that
this Honorable Court schedule a status conference to have a case management order entered,and in
particular, to explore the opportunity to enter negotiations, possibly through mediation.
5. Counsel for the parties have been provided copies of this Motion ten(10)days prior
to its filing, and with the exception of Mr. Shade and the Estate, their concurrence is given.
WHEREFORE, Petitioner, John Maxwell, requests that the court schedule a Status
Conference.
