STIPULATION AGAINST LIENS
THIS AGREEMENT made the~~ay of February, 2005, by and between Thomas
Building and Renovation, hereinafter referred to as Contractor,
AND
Jeffery R. Bell and Michelle Diane Bell, hereinafter referred to as Owners, whereby the fo
undertook and agreed to erect and construct a building on that certain lot of ground situate in
Middleton Township, Cumberland County, Pennsylvania and being more commonly known Lot 3
Prickley Pear Drive, as more particularly described in Exhibit "A" attached hereto and incorp rated
herein by reference.
NOW THEREFORE, THIS AGREEMENT WI1NESSETH: That the said Contractor for
and in consideration of the sum of($I,OO) Dollar to it in hand paid by Owners, the receipt w reof
is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, or
itself and its subcontractors, and all parties acting through or under them, covenant and agree t no
mechanic's liens or claims shall be filed or maintained by it or any of its subcontractors again t the
said buildings and the lot of ground appurtenant thereto for or on account of any work done
materials furnished by it or any of its subcontractors under said contract or otherwise, for, to ards,
in, or about the erection and construction of the said buildings on the lot above described, an the
said Contractor, for itself, its subcontractors and others under them hereby expressly waive d
relinquish the right to have, file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an
independent covenant

to a Final Subdivision Plan for Phase I of Hillcrest Farms West, prepared by RJ. isher
& Associates, Inc., being recorded in the Office of the Recorder of Deeds in and f r

BEGINNING at a point along the southern side of a 50 foot wide right-of-way kno n as
Prickly Pear Drive at the dividing line between Lots Nos, 2 and 3 of the hereinafte
mentioned Plan of Lots; thence continuing along said dividing line, South 60 degr es 33
minutes 14 seconds East, a distance of 198,08 feet to a point along the dividing Ii e

continuing along same, South 28 degrees 29 minutes 32 seconds West, a distan e of
