WHEREAS, FREDERICK C. MillER, the OWNER of the real estate described below, has or is about to
execute a contract with FRED RICK C. MillER , whose principal business address is

family dwelling upon lands situate at lOT NO. 25, ASHBURN AY, MECHANICSBURG, CU BERLAND
COUNTY, PENNSYLVANIA, and more particularly bounded and described on Exhibit "An attached ereto and
made a part hereof; and, ~
NOW, THEREFORE, this ~ ~ay o~. ,2005, before any authority had been given b
FREDERICK C.' MillER to commence work on said facilities, or purchase ate rials for
same, in consideration of making of the above-described Contract with FREDERICK C. MillER, 0 er, and in
further consideration of ' One ($1.00) Dollar paid to the general contractor by FREDERICK C. MillER, wner, the
receipt whereof is hereby acknowledged, It is agreed that no liens or claims shall be filed or maintained gainst the
Owner's facilities and the land above-described, or upon FREDERICK C. MillER, the Owner, by t e general
contractor, or any of its subcontractors, or by any of the materialmen or workmen, or any other pe son acting
through or under them, for or on account of any labor, or materials purchased, or extra labor 0 materials
purchased for, towards, in or about the erection, construction, design and improvement of said facil ies, under
said contract or otherwise, the right to have, file and maintain such liens or claims against the faciliti ,the land
above-described, and FREDERICK C, MillER, the Owner, being hereby expressly waived by t e general
contractor for itself, its subcontractors, all materialmen, or workmen and other acting through or under t em,

ALL THAT CERTAIN tract or parcel of land situate in the Townshi of
Lower Allen, County of Cumberland and Commonwealth of Pennsylvania, m re
particularly bounded and described as follows, to wit:
BEGINNING at a point on the western right of way line of Ashburn ay
(60 feet wide) at the dividing line between Lots Nos. 25 and 26 as shown on he
hereinafter mentioned plan; thence along the dividing line between Lots Nos, 25
and 26, North 73 degrees 50 minutes 49 seconds West, a distance of 123.88 fe to
a point at the dividing line between Lots Nos, 25, 26 and 27 as shown on the F nal
Resubdivision Plan of Allen Estates as recorded in Plan Book 73, Page 139;
thence along the dividing line between Lots Nos. 25, 27 and 28, North 34 deg ees

line of lands now or formerly of John G. Williams; thence along the southern ine
of lands now or formerly of John G, Williams, South 86 degrees 15 minute 00
seconds East, a distance of 164.13 feet to a point; thence along the dividing

distance of 257.03 feet to a point on the northern right of way line of Ash urn
