STIPULATION AGAINST LIENS
THIS AGREEMENT made the 1st of March, 2005, by and between
Wolf Builders, Inc.,
hereinafter referred to as Contractor,
AND
Scott A. Newhart and Tanya M. Smith,
hereinafter referred to as Owner,
whereby the former undertook and agreed to erect and construct a garage on that
certain lot of ground known as:
BEING Lot No. 3B as shown on the Preliminary/Final Subdivision Plan of Lots No . 3, 4
and 5 of the Wert Farm, prepared by RJ. Fisher and Associates, Inc" dated May
2000, and recorded in the Office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania, in Plan Book 81, Page 122, more fully bounded and descri ed
therein.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One and 00/100 Dollar ($1,00) 0
Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, nd
the further consideration mentioned in the agreement aforesaid, for themselves a d
their subcontractors, and all parties acting through or under them, covenant and gree
that no mechanic's liens or claims shall be filed or maintained by them or any of t em
against the said buildings and the lot of ground appurtenant thereto for or on ace unt of
any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said buil ings
on the lot above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims against the said buildin s or
any of them, and agree that this instrument, waiving the right of lien, shall be an
independent covenant.
