Contractor D. WHEREAS, BrianfSill and Jacqueline Jackson-DeGarcia of 1 Crooked Drive, Enola, PA 17025, is about to execute contemporaneously herewith, a contract, with Artistech, Inc. of 3 E. Red Gold Circle, Camp Hill, PA, for the erection of a building upon premises commonly known as 23 Windswept Way, Borough East Pennsboro, Cumberland County, Pennsylvania, as set forth in the deed dated 01/22/88, recorded at Book D-33, Page 952 (part of), in the Recorder's Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, October 24, 2014, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. A4-'-,3 426 es- Jacque fne Jackson- Garcia v EXHIBIT A ALL THAT CERTAIN piece or parcel of land situate in East Pennsboro Township, Cumberland County, Pennsylvania,more particularly bounded and described as follows, to wit: BEGINNING at a point located on the western right-of-way line of the Windswept Way at the southeast corner of Lot G4 on the hereinafter referenced Plan; thence along the southern boundary line of Lot G4, North 87 degrees 56 minutes 00 seconds West, a distance of 150.00 feet to a point on the Community Open Space on said Plan; thence along said Open Space the following three (3) courses and distances: (1) South 02 degrees 04 minutes 00 seconds West, a distance of 33.33 feet to a point; (2)thence South 13 degrees 09 minutes 00 seconds East, a distance of 115.81 feet to a point; (3)thence North 77 degrees 07 minutes 50 seconds East, a distance of 134.28 feet to a point on the right-of-way line of Windswept Way; thence along Windswept Way, by a curve to the right, having a radius of 300.00 feet and an arc length of 78.21 feet to a point; thence continuing along the same, North 02 degrees 04 minutes 00 seconds East, a distance of 33.15 to a point, the point and place of BEGINNING. BEING Lot G3 on the Final Subdivision Plan of Floribunda Heights, Phase I, Section 10.13 and recorded in the Cumberland County Recorder of Deeds Office at Instrument No. 201200886.
