PETITION TO AUTHORIZE THE CREATION AND FUNDING OF THE
IRREVOCABLE SPECIAL NEEDS TRUST FOR THE BENEFIT OF
TAMMY LEIGH DOUGHERTY OF MECHANICSBURG, CUMBERLAND COUNTY,
PENNSYLVANIA PURSUANT TO 42 U.S.C. SECT. 1396p(d)(4)(A)
ORDER
AND NOW, this '�$th day of �C�a�v�.0 , 2014, after consideration
of the PETITION TO AUTHORIZE THE CREATION AND FUNDING OF THE
IRREVOCABLE SPECIAL NEEDS TRUST FOR THE BENEFIT OF TAMMY LEIGH
DOUGHERT�' OF MECHANICSBURG, CUMBERLAND COUNTY, PENNSYLVANIA
PURSUANT TC) 42 U.S.C. SECT. 1396p(d)(4)(A), it is hereby ordered and decreed as follows:
A. A SPECIAL NEEDS TRUST as per that certain PETITION TO AUTHORIZE
THE CREATION AND FUNDING OF THE IRREVOCABLE SPECIAL NEEDS TRUST
FOR THE BENEFIT OF TAMMY LEIGH DOUGHERTY OF MECHANICSBURG,
CUMBERLAND COUNTY, PENNSYLVANIA PURSUANT TO 42 U.S.C. SECT.
1396p(d)(4)(A) is herel�y established. Said TRUST to be funded with TAMMY LEIGH
DOUGHERT'Y'S currently held assets and property which her current Co-Guardians, MILTON
M. DOUGHERTY, JR., DEBORAH DO�JGHERTY KNAUB and SANDRA L. DOWI�TEY, are
amenable to transferring, assigning and setting over to the Co-Trustees of the said TRUST for
the benefit of TA.MMY LEIGH DOUGI�ERTY, as is set forth more fully at large in said
PF,T�TIOl�'.

B. That MILTON M. DOUGHTERY JR., DEBORAH DOUGHERTY KNAUB,
and SANDRA L. DOWNEY, are hereby named and appointed as Co-Trustees of the said
SPECIAL NEEDS TRUST.
C. That no bond need be filed at present. In the future, if additional assets sufficient
to increase the corpus of the said TRUST to one hundred thousand ($100,000.00) dollars are
added to the Trust, the said Co-Trustees are to promptly notify the Orphans' Court at which time
the issue of the need for a bond will be re-addressed.
D. Establish a prepaid funeral account, according to the attached Malpezzi Funeral
Home Pre-Arrangement Worksheet, for the benefit of TAMMY LEIGH DOUGHERTY with
the Malpezzi Funeral Home in the amount of Nine Thousand Nine Hundred Eighty-One and
No/100ths (9,981.00) Dollars, to be paid from the approximately Twenty Thousand Eight
Hundred and No/100ths ($20,800) Dollars to be deposited into TAMMY LEIGH
DOUGHERTY'S Special Needs Trust.
E. This Order shall be docketed and filed in the Office of the Clerk of the Orphans'
Court and Certified copies may be made thereof from time to time as may be needed to prove the
authorities, empowerments and the appointment of the said Co-Trustees.
F. For purposes of reliance by third parties: A true and correct copy of this Order or
a Certified Copy of this Order, as the case may be, presented by any one of the Co-Trustees shall
be deemed to be and shall be considered to be conclusive proof that the other Co-Trustees have
failed to act, or are currently unable to act, or have ceased to serve.
