WHEREAS, MICHAEL E. STONER, II and TIFFANY STONER of 623 Stover ourt,
Hummelstown, Pennsylvania, is about to execute contemporaneously herewith, a contract, with
MCNAUGHTON HOMES of 4400 Deer Path Road, Suite 201, Harrisburg, Pennsylvania, for the er ction
of a building upon premises commonly known as 2340 GREENBRIAR LANE, Township HAMP EN,
CUMBERLAND County, Pennsylvania, as set forth in the deed dated j'v\o.rC h '] :}CQS ,re rded
at Deed Book , Page , in the Recorder's Office for CUMBERLAND C unty,
Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and at ached
hereto.
NOW, March 7, 2005, at the time of and immediately before the execution of the pr ncipal
contract, and before any authority has been given by the said Owner to the said Contractor to co ence
work on the said building, or purchase materials for the same in consideration of the making of e said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by wner,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, r extra
labor or materials purchased for the erection of said building, the right to file such liens being e ressly
waived.

ALL that certain piece, parcel or lot ofland situate in Hampden Township, C
COlUlty, Pennsylvania, and bounded and described as follows:
BEGINNlNG at a point on the Southern right-of-way line ofHeatherwood Co
feet wide), said point being located at the comer of other lands now or formerly of The
McNaughton Company; then along said right-of-way line South 88 degrees 14 minute 58
seconds East, for a distance of 117.93 feet, ~ a point on the arc of a circle curving to t e right,
having a radius of25,00 feet, and an arc length of38.78 feet, to a point on the Weste
right-of-way line of Greenbriar Lane (50,00 feet wide); then along said right-of-way li e of
Greenbriar Lane Sou1h 00 degrees 32 minutes 55 seconds West, for a distance of 15.3 feet, to a
point along same on the arc of a circle curving to the left, having a radius of 2,025.00 eet, and an
arc length of 72.26 feet, to a poillt in line of other lands now or formerly of The McN ghton
Company; then along said other lands of McNaughton, South 88 degrees 30 minutes 5 seconds
West, for a distance of 139.31 feet, to a point; then North 03 degrees 13 minutes 58 s onds
West, for a distance of 120.35 feet, to a point and the place of BEGINNING.
This piece, parcel or lot of land consists of approximately 16,381 square feet of land,
known and numbered as Lot No. 146 on the Final Subdivision Plan for Westbury - P
which is recorded in Cumberland County in Plan Book 89 ,Page 106.
UNDER AND SUBJECT TO:
(a) Any and all easements, licenses, exceptions, reservations, covenants
agreements, conveyances and restrictions which affect the premises nd
are visible by inspection of the premises.
(b) Any and all easements, licenses, exceptions, reservations, covenant ,
agreements, conveyances and restrictions contained in any and all p . or
agreements, leases, deeds, grants and conveyances affecting the pre ises_
(c) Plan notes prohibiting the construction of any structure (other than fence,
uncovered steps and entran,ce canopies - not greater than 3 feet in

(d) The Declaration of Covenants and Restrictions which is recorded i the
office of The Recorder of Deeds for Cumberland County in Misce laueous
Book 714, Page 2398, as maybe applicable to the premises,
