STIPULATION WAIVER OF RIGHT TO FILE LIEN
WHEREAS, T-A-H Construction, Inc. (hereinafter "CONTRACTOR"), having an office a 480
Running Pump Road, Lancaster, PA 17604, has entered into a contract dated January 5, 005
with Pennsylvania-American Water Company (hereinafter "OWNER"), having an office a 800
West Hershey Park Drive, Hershey, PA 17033, to provide materials and equipment a to
perform labor necessary for the construction of the Project entitled "Chloramination Fad ties
For Silver Spring Water Treatment Plant" situated in Silver Spring Township, Cumbe and
County, Pennsylvania, and located at 109 Sample bridge Road, Mechanicsburg, PA 17055.

NOW, THEREFORE it is hereby stipulated and agreed by and between the said pa les,
as part of the said contract and for the consideration therein set forth, that neither the undersi ed
CONTRACTOR, any subcontractor or material-man, nor any other person furnishing labo or
materials to the said CONTRACTOR under this contract shall file a lien, commonly call a
mechanic's lien, for work done or materials and equipment furnished to the said Project or ny
part thereof.
This stipulation is made and intended to be filed with the Cumberland Cou ty
Prothonotary within ten days after the date hereof, in accordance with the requirements of Ac of
Assembly of Pennsylvania, in such case provided.
