STIPULATION AGAINST LIENS
THIS AGREEMENT made the I-f+l..... day of mar ~

and between W. LEE ROLAND, BUILDER, of 104 Lavynndon Lane,
Mechanicsburg, Pennsylvania, hereinafter referred to as
Contractor, AND W. LEE ROLAND and ROSALIE H. ROLAND, husband and
wife, of 104 Lavynndon Lane, Mechanicsburg, Pennsylvania,
hereinafter referred to as Owner, whereby the former underto k
and agreed to erect and construct a residential dwelling on hat
certain lot of ground situate at Witney Ridge, in Upper AIle
Township, Cumberland County, Pennsylvania, being Lot No. 54,
Final Development Plan for Witney Ridge Planned Residential
Development phase I, said plan being recorded in plan Book 80
Pages 63-64. Being part of the same premises which Gene W.
Hollinger and Dorothy J. Hollinger, husband and wife, by Deed
dated August 17, 1999 and recorded in the Cumberland County
Recorder of Deeds Office in Deed Book 206, Page 23, granted an
conveyed unto Witney Ridge Investors, LP. Also being the same
premises which Witney Ridge Investors, LP by Deed dated
March 15, 2005 and recorded March 2005 in the Cumber1an
Recorder of Deeds Office in Deed Book

granted and conveyed unto W. Lee Roland and Rosalie H. Roland,
husband and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is

hereby acknowledged, and the further consideration mentione in
the agreement aforesaid, for themselves and their subcontra tors,
and all parties acting through or under them, covenant and a ree
that no mechanic's liens or claims shall be filed or maintai ed
by them or any of them against the said buildings and the 10 of
ground appurtenant thereto for or on account of any work don or
materials furnished by them or any of them under said contra t or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the r ght
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independen
covenant.
WITNESS our hands and seals, or if a corporation, it has
caused these presents to be signed by its proper corporate
officers and its corporate seal to be affixed hereto, the day nd
year above written.
