THIS AGREEMENT made this d 7-f'h day of 0C,-6L-&r 2014, by
and between
FARINELLI CONSTRUCTION, INC. , hereinafter referred to as
Contractor,
AND
Jonathan R. DeBernardis and Jennifer L. DeBernardis, husband and
wife, hereinafter referred to as Owner, whereby the contractor
undertook and agreed to erected and construct a single family
dwelling situate in Upper Allen Township, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot
86 Meadowview Estates, Mechanicsburg, PA 17055.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1 . 00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic' s liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic' s liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant .

Donald J. Farinelli, who acknowledged himself to be the President
of Farinelli Construction, Inc. , and that he as such President,
being authorized to do so, executed the foregoing document for
the purposes therein contained by signing the name of the said
Corporation by himself as such President. ;

Exhibit A
ALL THAT CERTAIN parcel of land located in Upper Allen
Township, Cumberland County,Pennsylvania, known as Lot 86 of a
subdivision of Meadowview Estates, Section I1, Phase VI-B and as
recorded July 23,2012 in the Cumberland County Court House as
Instrument No. 201221864.
BEGINNING AT A POINT, said point being on the southwesterly right
of way line of North Meadow Circle and is the common corner of Lot
85. Thence South 63 degrees, 49 minutes,32 seconds West, bordering
adjacent Lot 85 a distance of 227.44 feet to a point; thence North 47
degrees, 27 minutes, 21 seconds West, bordering a portion of Lot 83 of
Section 1I, Phase VI-A a distance of 104.75 feet to a point; thence North
23 degrees, 48 minutes, 04 seconds East, bordering adjacent lands now
or formerly of Lloyd B. Yorlets, a distance of 258.65 feet to a point;
thence South 68 degrees, 44 seconds, 14 minutes East a distance of
183.37 feet to the right of way of North Meadow Circle; thence along
said right of way curving to the left having an arc length of 144.89 feet,
a radius of 175.00 feet with a chord bearing of South 02 degrees, 27
minutes,21 seconds East and a chord length of 140.79 feet to a point,
being the point and PLACE OF BEGINNING.
BEING the same premises which Farinelli Construction,Inc. by deed
dated 9/29/14 and recorded 9/30/14 in Instrument#201422182 granted
and conveyed unto Jonathan R. DeBernardis and Jennifer L.
DeBernardis, husband and wife.
