' ro� �' a Mr7 ��, ---j <„ C-0 WHEREAS,ELIDIO J MONORITI died November 3, 2012;. and t-n WHEREAS, MARIANNE MORGANO was appointed Executrix of the Estate of ELIDIO J MONORITI, at the above number and term on November 28, 2012; and WHEREAS,the parties in interest are: Frances Barack 2120 Greentree Rd,Apt 707E, Pittsburgh PA 15220 Joseph Barack 2120 Greentree Rd,Apt 707E, Pittsburgh PA 15220 Anthony Barack 812 Bellaire Ave,Pittsburgh, PA 15226 Marianne Morgano, 1290 Lakemont Dr, Pittsburgh, PA 15243 WHEREAS, there are no unpaid creditors of the Estate; and WHEREAS, each of the parties hereto have been furnished with a complete listing of the estate assets and disbursements as set forth on the PA Inheritance Tax Return filed to this docket number; and WHEREAS, it is the desire of the parties to this Agreement that final distribution of this estate be accomplished without a formal accounting to the Orphans' Court Division of the Court of Common Pleas of Cumberland County, it being the desire of the parties to avoid the expense, delay and publicity of a formal accounting. NOW THEREFORE, WITNESSETH, in consideration of the mutual promises, covenants and agreements recited herein, and intending to be legally bound hereby,the parties do agree as follows: 1. Each of the parties to this Agreement does hereby release and forever discharge Marianne Morgano, Executrix,from any and all liability which may from time to time arise in connection with her service as Executrix of the Estate of Elidio J Monoriti,Deceased. The parties do further agree to indemnify and hold harmless said Marianne Morgano,Executrix, from any and all personal liability which may arise against the estate from creditors or other claimants. 2. Each of the parties does hereby acknowledge the accuracy of the inventory of assets, and distributions as indicated in the PA Inheritance Tax Return. t 3. Each party to this Agreement acknowledges that this Agreement shall be indexed and recorded in the estate proceedings and that the terms hereof shall be binding upon their respective heirs, successors, administrators and assigns. 4. This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania.
