hereinafter referred to as Owner, whereby the former undertook and agreed to co struct a
single family dwelling, in LOT #17 WENTWORTH ESTATES, HAMPDEN TOWNSHIP, CUMBE LAND
COUNTY, PA, more particularly described in attached exhibit "A",
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contract
and in consideration of the sum of ONE Dollar to it
paid by Owner, the receipt whereof is hereby acknowledged, and the further consi
mentioned in the agreement aforesaid, for themselves and their subcontractors, a
parties acting through or under them, covenant and agree that no mechanic's lien
claims shall be filed or maintained by them or any of them against the said buil
the lot of ground appurtenant thereto for or on account of any work done or mat
furnished by them or any of them under said contract or otherwise, for, towards,
about the erection and construction of the said buildings on the lot above desc
the said Contractor, for themselves, their subcontractors and others under them
expressly waive and relinquish the right to have, file, and maintain any mechani
or claims against the said buildings or any of them, and agree that this instrum

ALL THAT CERTAIN piece or parcel ofland situate in the Township of
Hampden, County of Cumberland and Commonwealth of Pennsylvania, lying along
Eaglesmoor Lane and being approximately 250 feet west of the intersection of
Eaglesmoor Lane and Pellingbam Circle, bounded and described as follows, to wit:
BEGINNING at the intersection of the westerly right-of-way line of
Eaglesmoor Lane (50 feet wide) with the line of division between Lot 16 and Lot 17;
extending (1) thence along Lot 16; North 63044'40" West, 359.81 feet; extending (2)
thence along Lot 18, North 77"09'51" East, 311.83 feet; extending (3) thence along
Lot 65C, South 43008'44" East, 156.32 feet to the westerly right-of-way line of
Eaglesmoor Lane; extending (4) thence along said right-of-way line, South
48017'15" West, 5.04 feet; extending (5) thence along the same by a curve to the
left, having a radius of 365.00 feet, an arc distance of 140.39 feet, and a chord
bearing and distance of South 37016'08" West, 139.52 feet to the place of
BEGINNING.
CONTAINING 1.052 Acres
SUBffiCf to a ten (10) foot wide storm drain easement, the northerly line
of which lies contiguous and parallel to the second (2) course and extending
between and extending up or contracting to course (1) and course (3) of the
previous description.
BEING Lot No. 17 as shown on a plan entitled "Final Subdivision Plan for
Phase 1, Wentworth Estates" dated 11120/2002, last revised 4/1112003, Job
Number 1001-846, prepared by LSC Design, Inc., York, PA and recorded in
Cumberland County Office of the Recorder of Deeds in Plan Book 87, Page 50.
BEING THE SAME PREMISES which Smith Land & Improvement Corporation and Ki sley
Equities II Limited Partnership by their Deed dated March 23, 2005 and about to be record din
the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, granted nd
conveyed unto Russell C. Goodling, adult individual, Grantor herein.
