This instrument is executed this .;29- day of March, 2005, by Hoffman's C stom
Contracting, Inc. ("Contractor") (or "Subcontractor"') in favor of John V. Zahos and Anast ia N.
Zahos ("Owners"). Whereas, Owners are about to execute contemporaneously herewith, a c tract
with Contractor for the erection of a principle residence upon a lot of land situate in Die 'nson
Township, Cumberland County, Pennsylvania, being known as Lot No. 38, Subdivision PI n for
Clarendon, as recorded in Cumberland County Plan Book 77, Page 56, more fully descri d as
follows:
ALL that certain lotofland situate in Dickinson Township, Cumberland County, Pennsylvania, bound and
described in accordance with Subdivision Plan for Clarendon, prepared by Statler-Brehm Associates Inc.,
dated June 10, 1998 consisting of 14 pages, a copy of which was recorded in the hereinafter n med
Recorder's Office on August 19, 1998 in Plan Book 77, Page 56, which Subdivision Plan for Claren on is
incorporated herein by reference, as follows:
BEGINNING at a point on the eastern line of Irene Court having a radius of 61 feet at the dividin line
between Lots Nos. 38 and 39; thence along said eastern line of Irene Court, by a curve to the left ha ng a
radius of 61 feet an arc distance of38.64 feet to a point; thence still along said eastern line of Irene ourt
by a curve to the right having a radius of 40 feet an arc distance of 51.42 feet to a point; thence still ong
said eastern line of Irene Court having a width of 50 feet, North 13 degrees 39 minutes 33 seponds E st a
distance of 166.47 feet to a point; thence by a curve to the right having a radius of 40.00 feet an arc dist nce
of56.13 feet to a point on the southern line of 50-feet wide Ashton Street; thence along the southern Ii e of
said 50-feet wide Ashton Street by a curve to the left having a radius of350.00 feet an arc distance of! 0 .66
feet to a point at the dividing line between Lots Nos. 37 and 38; thence along said dividing line between aid
Lots Nos. 37 and 38, South 32 degrees 56 minutes 08 seconds East a distance of320.99 feet to a point a the
dividing line between said Lots Nos. 38 and 39; thence along said dividing line between said Lots No 38
and 39 the following two courses and distances: (I) North 81 degrees 42 minutes 48 seconds West a dist ce
of230.36 feet to a point; and (2) South 66 degrees 51 minutes 52 seconds West a distance of92.08 fe t to
a point on the eastern line of said Irene Court at the place of BEGINNING.
THE above described lot of land is all of Lot No. 38 as shown on said Subdivision Plan for Clarendon nd
contains an area of 60,572 square feet, more or less, and has the mailing address of9 Irene Court, Carli Ie,

Now, , at the time of and immediately before the execution of the cons ruction
contract aforesaid, and before any authority has been given by the said Owners to the said Co tractor
to commence work on the said building, or purchase materials for the same, in consideratio of the
Owners making ofthe said contract with Contractor, and intending to be legally bound he eby, it
is agreed that no lien shall be filed against the building by Contractor, or any sub-contractor nor by
any of the materialmen or workmen or any other person for any labor, or materials purch ed, or
extra labor or materials purchased for the erection of said building, the right to file such lien being
expressly waived.
