WHEREAS, DANIEL J. PISCOTTY and LEANNE R. PISCOTTY, of Cum erland
County, Pennsylvania are about to execute contemporaneously herewith, a contr ct, with
DANIEL J. PISCOTTY, of Cumberland County, Pennsylvania, forthe erection of a uilding
upon a lot of land situate, lying and being in Dickinson Township, Cumberland ounty,
Pennsylvania, bounded and limited in accordance with Exhibit "A" attached heret ;
NOW, THEREFORE, on March 29, 2005, at the time of and immediately be ore the
execution of the principal contract, and before any authority has been given by t e said
Owner to the said Contractor to commence work on the said building, or p rchase
materials for the same in consideration of the making of the said contract with Con ractor
and the further consideration of One ($1.00) Dollar, to Contractor paid by Ow r, it is
agreed that no lien shall be filed against the building and/or land by the contractor or any
subcontractor, nor by any of the material men or workmen or any other person or any
labor, or materials purchased, or extra labor or materials purchased for the erectio of said
building, the right to file such liens being expressly waived.

ALL THAT CERTAIN tract of land situate in the Township of Dickinson, County of Cumberland and
Commonwealth of Pennsylvania, bounded and described as follows:
BEGINNING at an iron pin located on the southern right-of-way line of Walnut Bottom Road, S.R. 046
Northwest corner of Lot No.9 on the hereinafter mentioned Subdivision Plan; thence by said Lot NO.9 South 37
degrees 30 minutes 00 seconds East 510.34 feet to an iron pin; thence South 52 degrees 30 minutes 0
seconds West 186.12 feet to an iron pin at the Southeast corner of Lot NO.7 on the hereinafter mentio ed
Subdivision Plan; thence by said Lot NO.7 North 37 degrees 30 minutes 00 seconds West 509.71 feet to an iron
pin on the Southern right-of-way line of Walnut Bottom Road, S.R. 0465; thence by the Southern right- f-way
line of Walnut Bottom Road North 51 degrees 54 minutes 31 seconds East 117.39 feet to an iron pin; t ence by
the same North 52 degrees 59 minutes 20 seconds East 68.73 feet to an iron pin, the place of BEGIN ING.
CONTAINING 2.1808 acres, more or less, and BEING Lot NO.8 on the Final Subdivision Plan for Sam el H.
Brown recorded in Cumberland County Plan Book 66, Page 24A.
UNDER AND SUBJECT, further, to the Declarations, Protective Covenants, Restrictions and Reservat ns set
forth in an Agreement between Samuel H. Brown and Peggy Y. Brown, his wife, and Stephen E. Darr nd
Deborah A. Darr, his wife, dated June 4, 1976 and recorded in the Office of the Recorder of Deeds afo esaid in
Miscellaneous Book 222, Page 388, all terms and conditions of which are expressly incorporated herei by
reference thereto including the amendment hereinafter set forth and shall be binding upon the Grantee herein,
its successors and assigns.
Paragraph I of said Agreement is revoked in its entirety, and in lieu thereof Paragraph I is amended to rovide
as follows: In any case, with or without approval of Samuel H. Brown and Peggy Y. Brown, no one (1) tory or
split level dwelling shall be erected containing less than fourteen hundred (1400) square feet of floor s ace,
exclusive of porches, cellars, attics, and garages, and no one and one-half (1 %) story or two (2) story elling
shall contain less than eighteen hundred (1800) square feet of floor space, exclusive of porches, cellar, attics,
and garages.
