ITEM ONE
� I hereby direct my Personal Representative hereinafter named to
pay from my Estate all of my just debts and funeral expenses and the expense
� '� of administering my Estate. I direct that my body be interred in a cemetery
� lot provided for me beside that of my first wife, VIOLET, in a cemetery

located in the town of Goodyear, State of Pennsylvania, with a suitable
but modest monument and/or marker thereon as may be required.
I7EM TWO
After the payment of my debts and funeral expenses and the
expense of administering my Estate I then direct that the rest, residue
and remainder of my property be disposed of in the following manner:
a. In accordance with the Will of my late Wife, NEVA, my
home residence property at 5614 Remmell Avenue in Baltimore City, Maryland,
is to belong to my step-daughter, BOBBIE JEAN COTHRON, of the State of
North Carolina.
b. I give and devise to my niece, ANN TRAVIS of Gardners,
R.D. #2 Pennsylvania, the real property which I own in Goodyear, State of
Pennsylvania.
c. I give and devise to my niece, ANN TRAVIS, the sum of
Fifty Thousand ($50,000.00) Dollars.

I hereby direct that any and all inheritance and estate taxes

�� insurance on my life, or with respect to any property that may pass at my
�. death by survivorship, or any property which may be otherwise considered
as part of my Estate for the purpose of taxation, shall be paid by my
Executor hereinafter named out of the principal of my Estate to the end
and intent that all persons who may receive any property and interest
(including insurance) under the terms of this Will , or which may be other-
wise received from me or by reason of my death, shall receive the same free
and c7ear of any such taxes.

I appoint as my Personal Representative my attorney, RONALD J.
KEARNS and as substitute Co-Personal Representatives I appoint my neice,
ANN TRAVIS and my step-daughter, BOBBIE JEAN COTHRON. I direct tF�at my

shall serve without bond or security except as may be required by law. I

PETITION TO REOPEN ESTATE AND APPOINT SUBSTITUTE PERSONAL
REPRESENTATIVE
Comes now Petitioner, Ann B. Travis, as an Interested Person pursuant to
Section 2-102( c ) of the Estates and Trusts Article, Annotated Code of Maryland, and
petitions this Court to re-open the estate.
1. The undersigned states that this estate has been settled in Baltimore City,
Maryland and the personal representative discharged.
2. However, on the date when the estate was closed, a necessary act remained
unperformed by the personal representative. In the Last Will and Testament of John
M. Delp, the decedent directed that the real property which he owned in Goodyear,
Cumbe�land County, state of Pennsylvania be given and devised to the undersigned,
his niece.
3. The First and Final Administration Account filed by the personal representative,
Ronald J. Kearns, identified as a miscellaneous asset"Real Estate Owned by
Decedant (sic) in Pennsylvania State having a value of$500.00." The aforementioned

Real Estate is the only real property in the state of Pennsylvania specifically identified
in both the Last Wili and Testament of John M. Delp and the First and Final
Administration Account of the personal representative.
4. Petitioner states that the Estate was improperly closed without the administration
being completed. Specifically, a necessary act remains unperformed by the personal
representative, to wit, conveyance of title to the real property owned by the decedent in
Goodyear, Cumberland County, state of Pennsylvania to Petitioner of specific
devise of said land.
5. The personal representative originally appointed is not petitioning this Court for
the relief being requested because the personal representative, Ronald J. Kearns, is
deceased. As proof of the death of Ronald J. Kearns on November 4, 2003, Petitioner
� attaches hereto and incorporates herein by reference as Exhibit One (1) a copy of the
obituary of Ronald J. Kearns from the Baltimore Sun newspaper dated November 10,
2003. The Last Will and Testament of John M. Delp appointed as substitute co-
personal representatives the undersigned and the step-daughter of John M. Delp,
Bobbie Jean Cothron. Bobbi Jean Cothron is deceased, having died prior to the
administration of the Estate. As proof of the death of Bobbi Jean Cothron, Petitioner
cites and refers to Invoice No. 05082 in the Inheritance Tax Document previously filed
in this Estate. Therefore, the Petitioner requests that she be appointed substitute
personal representative for the sole purpose of transfer�ing the title to the real property
