COMPLAINT
1. Plaintiff, Capital One Bank, ("Capital One") is a banking institution ith an
address of 456 N. Kimball Place, Boise, ID 83704.
2. Defendant, Elizabeth Teves, is an adult individuals with an address of 5 eaver
Road, Camp Hill, P A 17011.
3. Capital One issued the Defendant a credit card subject to the terms of the
Cardmember Agreement ("Cardmember Agreement"). A true and correct copy ofthe Card mber
Agreement is attached hereto, made a part hereof and marked as Exhibit "A".
4. Defendant has incurred charges for purchases, cash advances and/or fi lance
charges in the amount of SEVEN THOUSAND ONE HUNDRED SIXTY-ONE and 5 /100
DOLLARS ($7,161.55) as of February 7, 2005.
5. Defendant's obligations are based on a subsisting debt, were in writing and flse
from a preexisting account.
6. Defendant is liable to Capital One on this debt as an account stated.
7. Defendant has defaulted on his obligation to make payments to Capital On by
failing to make any payments from and after January 5, 2005.
8. Pursuant to the Cardmember Agreement, Capital One may declare a 1 amounts
due under the Cardmember Agreement immediately due and payable without notice or emand.
9. Under the Cardmember Agreement, Defendant is required to pay all the ttomey's
fees Capital One incurred in exercising its right to collect, which Capital One anticipat to be in
the amount of FIVE HUNDRED and 00/100 DOLLARS ($500.00).
10. As of February 7, 2005, Defendant is indebted to Capital One under
the Cardmember Agreement in the amount of SEVEN THOUSAND ONE HUNDRED SIX Y-ONE
and 55/100 DOLLARS ($7,161.55), plus interest accruing from and after February 7, 20 5 at the
per annum rate of 6%.
WHEREFORE, Capital One demands judgment against the Defendant in the ount
of SEVEN THOUSAND SIX HUNDRED SIXTY-ONE and 55/100 DOLLARS ($7, 61.55)
(comprised of real debt in the amount of SEVEN THOUSAND ONE HUNDRED SIXTY -0 E and
55/100 DOLLARS ($7,161.55) and anticipated attorney's fees in the amount of FIVE HUN RED
and 00/100 DOLLARS ($500.00)) plus interest from and after February 7, 2005, at the per nnum
rate of 6% and costs of suit.

PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT
The Plaintiff, Capital One Bank, ("Capital One") by its attorneys, Douglas M. Marinos &
Associates, P.C., moves the court for the entry of a summary judgment in its favor in this action
under the provisions of Pennsylvania Rule of Civil Procedure 1035 and in support thereof, states the
following:
1. Capital One commenced the above-captioned action by filing its Complaint on April
18, 2005. A true and correct copy of Capital One's Complaint is attached hereto, made a part hereof,
and marked as Exhibit "A".
2. The ad damnum clause of Capital One's Complaint demands judgment in its favor
against Defendant in the amount of SEVEN THOUSAND SIX HUNDRED SIXTY -ONE AND
55/100 DOLLARS ($7,661.55) (comprised ofreal debt in the amount of SEVEN THOUSAND ONE
HUNDRED SIXTY-ONE AND 55/100 DOLLARS ($7,161.55) and anticipated attorney's

DOLLARS ($7,161.55) as of February 5,2005;
(e) Defendant's obligations are based on a subsisting debt, were in writing and
arises from a preexisting account;
(f) Defendant is liable to Capital One on this debt as an account stated;
(g) Defendant has defaulted on her obligation to make payments to Capital One
by failing to make any payments from and after January 5, 2005;
(h) Pursuant to the Cardmember Agreement, Capital One may declare all
amounts due under the Cardmember Agreement immediately due and payable without notice or
demand;
(i) Under the Cardmember Agreement, Defendant is required to pay all the
attorney's fees Capital One incurred in exercising its right to collect, which Capital One anticipates
to be in the amount of FIVE HUNDRED AND 00/100 DOLLARS ($500.00); and
(j) As of February 7, 2005, Defendant is indebted to Capital One under the
Cardmember Agreement in the amount of SEVEN THOUSAND ONE HUNDRED SIXTY-ONE
AND 55/100 DOLLARS ($7,161.55), plus interest accruing from and after February 7, 2005 at the
per annum rate of6%. (Capital One's Complaint and Defendant's Answer ~~ 1-10).
7. Defendant's Answer responds to Capital One's material averments with denials so
lacking in specificity that they must be admitted pursuant to Pa.R.C.P. No. 1029(b). (Capital One's
Complaint and Defendant's Answer).

8. The Exhibit attached to Capital One's Complaint provide Defendant with
sufficient information to admit or deny the allegations referenced in paragraph 8 hereof, and
accordingly, the allegations must be deemed admitted pursuant to Rule 1029(b) for Defendant's
failure to specifically deny the same.
9. Notwithstanding the general denial of Defendant's Answer, Defendant is indebted
to Capital One is under the Cardmember Agreement in the amount of SEVEN THOUSAND ONE
HUNDRED SIXTY-ONE AND 551100 DOLLARS ($7,161.55)plusinterestaccruingfromandafter

COMPLAINT
1. Plaintiff, Capital One Bank, ("Capital One") is a banking institution with an
address of 456 N. Kimball Place, Boise, ID 83704.
2. Defendant, Elizabeth Teves, is an adult individuals with an address of 5 Beaver
Road, Camp Hill, P A 17011.
3. Capital One issued the Defendant a credit card subject to the terms of the
Cardmember Agreement ("Cardmember Agreement"). A true and correct copy of the Cardmember
Agreement is attached hereto, made a part hereof and marked as Exhibit "A".
4. Defendant has incurred charges for purchases, cash advances and/or finance
charges in the amount of SEVEN THOUSAND ONE HUNDRED SIXTY-ONE and 55/100
DOLLARS ($7,161.55) as of February 7, 2005.
5. Defendant's obligations are based on a subsisting debt, were in writing and arise
from a preexisting account.
6. Defendant is liable to Capital One on this debt as an account stated.
7. Defendant has defaulted on his obligation to make payments to Capital One by
failing to make any payments from and after January 5, 2005.
8. Pursuant to the Cardmember Agreement, Capital One may declare all amounts
due under the Cardmember Agreement immediately due and payable without notice or demand.
9, Under the Cardmember Agreement, Defendant is required to pay all the attorney's
fees Capital One incurred in exercising its right to collect, which Capital One anticipates to be in
the amount of FIVE HUNDRED and 00/100 DOLLARS ($500,00).
10. As of February 7, 2005, Defendant is indebted to Capital One under
the Cardmember Agreement in the amount of SEVEN THOUSAND ONE ffiJNDRED SIXTY -ONE
and 55/100 DOLLARS ($7,161.55), plus interest accruing from and after February 7,2005 at the
per annum rate of 6%,
WHEREFORE, Capital One demands judgment against the Defendant in the amount
of SEVEN THOUSAND SIX HUNDRED SIXTY-ONE and 55/100 DOLLARS ($7,661.55)
(comprised of real debt in the amount of SEVEN THOUSAND ONE HUNDRED SIXTY-ONE and
55/100 DOLLARS ($7,161.55) and anticipated attorney's fees in the amount of FIVE illJNDRED

I received this on April 28, 2005. I have had no correspondence with Capital One since
Sept., 2004 when I received the attached letter from NCO Financial Systems. Attached is
also a copy of the cancelled check. Therefore, I was unaware of this debt. It was not on
my Credit Report last November when I was going over it.

Explanatory Comment
The Supreme Court of Pennsylvania has promulgated new Rule of Civil Procedure 230.2 governing the termination of
inactive cases and amended Rule of Judicial Administration 1901. Two aspects of the recommendation merit
comment.
I. Rule of civil Procedure
New Rule of Civil Procedure 230.2 has been promulgated to govern the ternunarion of inactive cases within the
scope of the Pennsylvania Rules of Civil Procedure. The termination of these cases for inactivity was previously
governed by Rule of Judicial Administration 1901 and local rules promulgated pursuant to it. New Rule 230.2 is
tailored to the needs of civil actions. It provides a complete procedure and a uniform statewide practice, preempting
local rules.
This rule was promulgated in response to the decision of the Supreme Court in Shop v. Eagle, 551 Pa. 360,710 A.2d
1104 (1998) in which the court held that "prejudice to the defendant as a result of delay in prosecution is required
before a case maybe dismissed pursuant to local rules implementing Rule of Judicial Administration 1901."
Rule of Judicial Administration 1901(6) has been amended to accommodate the new rule of civil procedure. The
general policy of the prompt disposition of matters set forth in subdivision (a) of that rule continues to be applicable.
II Inactive Cases
The purpose of Rule 230.2 is to eliminate inactive cases from the judicial system. The process is initiated by the
court. After giving notice of intent to terminate an action for inactivity, the course of the procedure is with the parties.
If the parties do not wish to pursue the case, they will take no action and "the Prothonotary shall enter an order as of
course ternunating the matter with prejudice for failure to prosecute." If a party wishes to pursue the matter, he or she
will file a notice of intention to proceed and the action shall continue.
a. Where the action has been terminated
If the action is ternunated when a party believes that it should not have been terminated, that party may proceed
under Ru1e230(d) for relief from the order of temunarion. An example of such an occurrence might be the termination
of a viable action when the aggrieved party did not receive the notice of intent to terminate and thus did not timely file
the notice of intention to proceed.
The timing of the filing of the petition to reinstate the action is important. If the petition is filed within thirty days of
the entry of the order of termination on the docket, subdivision (d)(2) provides that the court must grant the petition and
reinstate the action. If the petition is filed later than the thirty-day period, subdivision (d)(3) requires that the plaintiff
must make a showing to the court that the petition was promptly filed and that there is a reasonable explanation or
legitimate excuse both for the failure to file the notice of intention to proceed prior to the entry of the order of
ternnation on the docket and for the failure to file the petition within the thirty-day period under subdivision (d)(2).
B. Where the action has not been terminated
An action which has not been terminated but which continues upon the filing of a notice of intention to proceed may
have been the subject of inordinate delay. In such an instance, the aggrieved party may pursue the remedy of a
common law non pros which exits independently of termination under Rule 230.2.
