WHEREAS, Braam Hattingh of 5130 East Trindle Road, Mechanicsburg, PA, is about t
execute contemporaneously herewith, a contract, Wi1h Womex, Inc., of 201 S. Fileys Road, Dill urg,
PA, for site improvement work upon the premises commonly known as 1633 Trindle Road,
Mechanicsburg, Middlesex Township, Cumberland County, Pennsylvania, as set forth in the dee
dated Ie)" 14-0G. ,at Deed Book 00252, Page Number 01130, in the Recorder's Office for
Cumberland County, Pennsylvania, being the same premises identified in the Cumberland Coun Tax
Assessment Office as Tax Parcel Identification Number 21-09-0535-001, and as more specificall
described in Exhibit" A" which is incorporated herein and attached hereto.
NOW, April 6,2005, at 1he time of and immediately before the execution of the princi al
contract, and before any authority has been given by the said Owner to the said Contractor to
commence work on the said site improvements, or purchase materials for the same in considera ion of
the making of the said contract with Contractor and the further consideration of One Dollar ($1 00), to
Contractor paid by Owner, it is agreed that no lien shall be filed against the premises by the
Contractor, or any snbcontractor, nor by any of the materialmen or workmen or any other per n for
any labor, or materials purchased, or extra labor or materials purchased for the site improvem ts, the
right to file such liens being expressly waived.
