STIPULATION AGAINST LIENS

THIS AGREEMENT made this (/ day of 2005, by and
between Yanek Custom Homes, Ine., of 8 Ridge Road, Cumbe and
County, Boiling Springs, Pennsylvania, hereinafter referred t as
Contractor,
AND
TERRANCE A. WEST AND JOAN L. WEST, husband and wife, hereina
referred to as Owners, whereby the contractor undertook and ag
to erected and construct a dwelling on the certain lot of gr
situate in South Middleton Township, Cumberland Cou ty,
Commonwealth of Pennsylvania, and more fully described in Exh'
"A" which is attached hereto and made a part hereof known as
#62 Netherby, South Middleton Township, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the s id
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is her y
acknowledged, and the further consideration mentioned in e
agreement aforesaid, for itself, himself or themselves and its, s
or their subcontractors, and all parties acting through or und r

buildings and the lo,i;.' of ground appurtenant thereto for or n
account of any work done or materials furnished by them or any f
them under said contract or otherwise, for, towards, in, or abo t
the erection and construction of the said buildings on the I t
above described, and the said Contractor, for itself, himself r
themselves, its, his or their subcontractors and others under the
hereby expressly waive and relinquish the right to have, file, a
maintain any mechanic's liens or claims against the said buildin s
or any of them, and agree that this instrument, waiving the rig
of lien, shall be an independent covenant.

ALL that certain tract or lot of land lying and being situate in South Middleton
Township, Cumberland County, Pennsylvania, bounded and described as follows:
BEGINNING at a point on the southern right of way line of Waverly Lane and sai
beginning point further being on the southern line of a concrete walk paralleling
aforesaid Waverly Lane at the dividing line of Lot 62 herein conveyed and Lot 61
shown on the hereinafter mentioned Subdivision Plan; thence along the southern
line of a concrete walk paralleling the southern line of Waverly Lane following a
curve to the left with a radius of 225.00 feet an arc length of 76.79 feet and a chord
bearing North 61 degrees 30 minutes 15 seconds East with a chord length of 76.42
feet to a point at the dividing line of Lot 69; thence along Lot 69 South 38 degrees 16
minutes 22 seconds East, a distance of 139.16 feet to a point at the dividing line of
Lot 68; thence along Lot 68 and Lot 67 South 18 degrees 06 minutes 12 seconds
