White, hereinafter referred to as Owner, whereby the former undertook and agreed to er t and construct a singie family dwelling on that certain lot of ground situate in Lot 6, Lisburn Meadows North Mechanicsburg, Monroe Township, Cumberland County, PA. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereo is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and a ree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the aid buildings and the lot of ground appurtenant thereto for or on account of any work done or material furnished by them or any of them under said contract or otherwise, for, towards, in, or about the er ctlon and construction of the said buildings on the lot above described, and the said Contractor, for the selves, their subcontractors and others under them hereby expressly waive and relinquish the right to hav ,file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree at this instrument, waiving the right of lien, shall be an indeprndent covenant. / I) (- WITNESS our hands and seals this '~ day of March, 2005. ALL THAT CERTAIN tract of land situate in Monroe Township, Cumberland County, Pennsylvania, and more particularly identified as follows: BEGINNING at a point on the southern right-of-way of Meadow Lane (a 50 foot right-of-way) of the aforementioned Plan at the dividing line between Lot NO.6 and Lot No.4, South 00 degree 56 minutes 27 seconds East 495.77 feet to a point; thence along the dividing line Lot No.6 and Lot No. 30, North 49 degrees 15 minutes 57 seconds West a distance of 168.79 feet to a point; thence continuing along Lot no. 6 and Lot No. 30 South 89 degrees 03 minutes 32 seconds W st 95.57 feet to a point; thence along the northern right-of-way of Loop Road (a 50 foot wide right f- way) of the aforementioned Plan, North 00 degrees 56 minutes 28 seconds West 333.54 feet t a point; thence by a curve to the right having a radius of 50.00 feet, an arc iength of 78.54 feet; thence along the northern right.of-way of Meadow Lane ( a 50 foot wide right-of-way) of the aforementioned Plan North 89 degrees 03 minutes 33 seconds East 171.64 feet to a point and place of BEGINNING. LOT NO.6 on the Final Subdivision Plan for Lisburn Meadows Estates.North, Phase I, record in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan B ok 77, Page 37 et. seq., the metes and bounds description, for which lot is attached hereto as ex ibit "A", incorporated herein by reference and made a part hereof. UNDER AND SUBJECT, NEVERTHELESS, to the conditions, restrictions and easements as noted on the hereinabove mentioned Final Subdivision Plan; AND SUBJECT, FURTHER to th Declaration of Protective Covenants, Conditions, Restrictions and Reservations for Lisburn Meadows Estates.North dated June 151h, 1998, and recorded in the Office of the Recorder of Deeds, aforesaid, in Misc. Book 582, Page 936, including but not limited to: All drainage easements and detention basins applicable to the herein described lot and detail d on said Final Subdivision Plan.
