MUNICIPAL LIEN FOR SEWER/WATER RATES
NOW COMES the Borough of Mechanicsburg Cumberland County,
Pennsylvania, by its attorney Lisa Marie Coyne, Esquire, and files the within
claim for charges assessed with respect to sewer and /or refuse rates
against above named owner or owners and against the hereinafter
described real estate as follows:
STATEMENT OF CLAIM
1. This claim is filed by the Borough of Mechanicsburg, a borough organized
and existing in accordance with the laws of the Commonwealth of
Pennsylvania.
2. The owner or reputed owner of the property, or party or parties
responsible or liable, for which this claim is filed is the Defendant(s).
3. The authority under which the sewer and/or refuse rates were changed
and assessed is the Act of July 18, 1935, P.L. 1286, Section 1, 53 P.S. § 2231,
as amended.
4. Plaintiff has made demands for payment for services; however,
Defendant(s) have not made payments for the services provided.
5. The authority under which this claim is filed is the Act of May 16, 1923
P.L. 207, Section 9, et seq., 53P.S. §7143, as amended.

6. A description of the property against which this claim is filed is:
324 West Allen Street
Borough of Mechanicsburg
Cumberland County
Pennsylvania 17055
TAX PARCEL NUMBER 19-23-0567-045
7. This claim has not been the subject of any previous claim and judgment
in the Court of Common Pleas of Cumberland County for sewer and/or
refuse charges.
8. The total amount of the charges for which this claim is filed is five hundred
and fifty-seven dollars and ninety cents ($557.90), plus costs
and reasonable attorney's fees.
9. The time period for which these charges are filed is October 1, 2013 to
September 30, 2014 on.Sewer and Refuse Account 4200-0.
WHEREFORE, Claimant requests that a Municipal Lien be entered in
its favor and against the Defendants in the amount of five hundred and
fifty-seven dollars and ninety cents ($557.90), plus cost and reasonable
attorney's fees.

William Baum; thence along said lot Northward,a distance of one hundred and seventy-
one(17 1) feet to a fourteen foot alley; thence along said alley Eastward a distance of
forty-one and five-tenths (41.5)feet to corner of lot of said Birdella E.Kaley; thence
along said lot Southward,a distance of one hundred and seventy-one(171)feet to the
place of BEGINNING.
BEING THE SAME PREMISES which Rhoda R. Smith,by her deed dated
February 17, 1945 and recorded in Cumberland County Deed Book 12,Volume X,page
359, granted and conveyed unto Robert C. Kaley and Mabel C. Kaley. Mabel C. Kaley
died May 5, 1967 whereupon sole title became vested.in Robert C. Kaley.., .

AFFIDAVIT

COUNTY OF CUMBERLAND
I,MABEL K. HOUGH,hereby state that the following facts, of which I have
personal knowledge, are true and correct to the best of my knowledge, information and
belief.
1. This Affidavit is being filed to clarify the title history of a certain parcel of
real property known as 324 W. Allen Street,Mechanicsburg Borough, Cumberland
County, Pennsylvania.
2. The record owner of the property is Robert C. Kaley and Mabel C. Kaley,
husband and wife.
3. Mabel C. Kaley died May 5, 1967, vesting sole title in her surviving
spouse,Robert C. Kaley.
4. Paragraph No. 2 of the Robert C. Kaley will provided as follows: "I give
and bequeath my House and Lot of Ground,located at 324 West Allen Street,
Mechanicsburg, Cumberland County, Pennsylvania,together with any household
furnishings which I may own at the time of my decease and which may be located in said
premises,t my two daughters, Mabel K. Hough and Miriam D. Kaley, or to the survivor,
of said two, should either of them predecease me, for and during the term of their natural
lives."
5. Miriam D. Kaley died January 11,2006, so her life estate in the real estate
lapsed. Her estate was probated in Cumberland County and assigned No. 21-06-0088.
Her entire estate was given to her sister, Mabel K. Hough.
6. Mabel K. Hough moved from the residence in 2006 and renounces her
right to continue to reside therein.
7. When Robert C. Kaley died in 1972 as a widower, he was survived by five
children: Fred C. Kaley, Richard Kaley, William Kaley,Mabel K. Hough and Miriam D.
Kaley.
8. William Kaley died December 29, 1982,was not survived by a wife or
children and his estate was not probated.

9. Fred C. Kaley died March 5, 1977, survived by his wife Mildred Kaley,a
daughter Susan Dietrich and a daughter,Jyl F. Myers. Mildred Kaley died August 17,
1998.
10. Richard Kaley died June 25, 1975,survived by his wife Phyllis Kaley.
Phyllis died January 12, 1999 and her estate was probated in York County,Pennsylvania,
and assigned No. 67-1999-141.
