V. : CIVIL ACTION -LAW JOHN J. LANDRY and KIMBERLY G. LANDRY, husband and wife, : JURY TRIAL DEMANDED Defendants. COMPLAINT AND NOW comes Plaintiff, by and through its legal counsel, and avers as follows: 1. Plaintiff is Northeast Pool Supply, Inc., a Pennsylvania corporation with a principal place of business at 481 Front Street,New Cumberland,New Cumberland Bureau, Pennsylvania. 2. Plaintiff is engaged in the business of the installation of residential swimming pools. 3. Defendants are John J. Landry and Kimberly G. Landry,husband and wife, adult individuals residing at and owning, in joint names, 6115 Run Cross Lane, Enola, Hampden Township, Pennsylvania(hereinafter referred to as the "Property"). 4. The deed for the Property is recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania at Instrument Number 201300706. COUNT I -BREACH OF CONTRACT 5. On April 19, 2014, Plaintiff and Defendants entered into a written Swimming Pool Contract(hereinafter referred to as the "Contract"), a copy of which is attached hereto as Exhibit"A." Page 1 of 6 6. The Contract calls for the performance of certain work and the furnishing of certain materials by Plaintiff, namely the installation of a swimming pool and related accessories on the Property. 7. The total price for the work and materials listed in the Contract is Thirty-Nine Thousand One Hundred Ninety-Five and No/100 Dollars ($39,195.00). 8. The Contract specifies the following payment terms: a. A 10% deposit is due upon the signing of the Contract; b. An 80%payment is due on"the day of delivery of pool and start of excavation;" and C. The final 10%payment is due upon completion. 9. On April 19, 2014, Defendants paid to Plaintiff Four Thousand and No/100 Dollars ($4,000.00) representing the deposit due under the Contract. 10. On May 22, 2014,Defendants paid to Plaintiff Twenty-Four Thousand and No/100 Dollars ($24,000.00)representing the second payment due under the Contract. 11. During the course of the swimming pool installation, Defendants verbally requested various additional work items, "add-ons," and accessories not contemplated by the Contract (hereinafter referred to as"Verbal Additions")to be performed and/or provided by Plaintiff. 12. The Verbal Additions were completed by Plaintiff and were memorialized in a document provided by Plaintiff to Defendants titled, "Landry payment list/worksheet," a copy of which is attached hereto as Exhibit`B." 13. The total cost for the Verbal Additions is Seven Thousand Seven Hundred Forty-Four and Page 2 of 6 No/100 Dollars ($7,744.00). 14. During the course of the swimming pool installation, Defendants were contacted by Hampden Township and informed that some action would be required by Defendants, which may include the construction of a retaining wall on the Property, in order to meet township drainage requirements required for township approval of the project. 15. Pursuant to the Contract, Defendants are required to: a. "be responsible for all zoning requirements and for the pool locations being...clear of...restrictions." b. "clear and prepare site for pool...and if any extra labor or material is required therefor, the same will be paid by the [Defendants]." C. "warrant that...there are no zoning limitations or restrictions preventing the performances of this agreement. [Defendants] agree to apply for and obtain and deliver any necessary building permits." d. "construct any necessary or desirable retaining walls..." 16. Plaintiff advanced, on behalf of Defendants, Three Thousand Five Hundred Twelve and 50/100 Dollars ($3,512.50)to Hoover Engineering Services, Inc. for purposes of obtaining an engineering report for submission to Hampden Township to address the Township's correspondence to the Defendants regarding the drainage issue. 17. Plaintiff's advancement of monies to Hoover Engineering Services, Inc. was in an effort to assist Defendants in fulfilling their duties under the Contract described in Paragraph 15 of this Complaint. 18. Defendants have not reimbursed Plaintiff for the monies advanced to Hoover Engineering Page 3 of 6 Services, Inc. or any part thereof. 19. On or prior to October 24, 2014, Plaintiff performed all of the work and delivered all of the materials contemplated by the Contract and the Verbal Additions. 20. Plaintiff is holding various items as a courtesy to Defendants and plans to deliver the items and provide training regarding the swimming pool in spring 2015 at or around the date on which the pool is to be opened for the swimming season. These items are listed in a document titled, "Landry Pool - October 28, 2014," which has been provided to Defendants and a copy of which is attached hereto as Exhibit"C." 21. Plaintiff has offered to provide the items listed in Exhibit"C"to Defendants now and provide the aforementioned training now but has received no response from Defendants in this regard. 22. Plaintiff having completed all of the work and delivered all of the materials contemplated by the Contract and the Verbal Additions, the balance of Eighteen Thousand Nine Hundred Thirty-Nine and No/100 Dollars ($18,939.00)became due and owing on October 24, 2014. 23. Plaintiff and Plaintiff's counsel have repeatedly demanded payment of the amount due Plaintiff by Defendants, but Defendant has refused to pay the same or any part thereof. 24. Plaintiff having advanced Three Thousand Five Hundred Twelve and 50/100 Dollars ($3,512.50) for services provided by Hoover Engineering Services, Inc. for the benefit of Defendants,this amount is now due and owing. WHEREFORE, Plaintiff demands judgment against Defendants for the sum of Twenty- Two Thousand Four Hundred Fifty-One and 50/100 Dollars ($22,451.50), with interest from Page 4 of 6 October 24, 2014, and costs, along with such other relief as the Court may deem appropriate. COUNT II - QUANTUM MERUIT In the event it is determined that no valid written or oral agreement existed in fact or in law between Plaintiff and Defendants for any of the work completed or materials provided as alleged in Count 1, the Plaintiff avers as follows: 25. The averments of Paragraphs 1 through 24 of this Complaint are incorporated herein as if set forth at length. 26. On or prior to October 24, 2014, the Plaintiff, at the request of Defendants and with the Defendants' knowledge and acquiescence, constructed a swimming pool in the rear of the Defendants' home at 6115 Run Cross Lane, Enola, Hampden Township, Pennsylvania and provided Defendants with various materials related to the swimming pool in accordance with the direction of Defendants. 27. The fair market value of said construction, material, and labor at the time they were furnished was Forty-Six Thousand Nine Hundred Thirty-Nine and 00/100 Dollars ($46,939.00). 28. Defendants have paid to Plaintiff Twenty-Eight Thousand and No/100 Dollars ($28,000.00). 29. Defendants have refused to pay to Plaintiff the remaining fair market value of the construction, materials, and labor furnished which amounts to Eighteen Thousand Nine Hundred Thirty-Nine and No/100 Dollars ($18,939.00). 30. For the benefit of Defendants in connection with and in the course of the Plaintiff's installation of the swimming pool on the Property, Plaintiff advanced the sum of Three Page 5 of 6 Thousand Five Hundred Twelve and 50/100 Dollars ($3,512.50)to Hoover Engineering Services, Inc. as set forth in Paragraph 16 of this Complaint. 31. Defendants have not reimbursed Plaintiff for the sum Plaintiff advanced to Hoover Engineering Services, Inc. but have reaped the benefit of the same. 32. It would be unjust and inequitable to permit Defendants, in light of Defendants' failure to pay Plaintiff, to retain the benefits of the swimming pool installed at Defendants' request by Plaintiff as well as the services rendered by Hoover Engineering Service, Inc. for which Plaintiff advanced payment on behalf of Defendants. WHEREFORE, Plaintiff demands judgment against Defendants for the sum of Twenty- Two Thousand Four Hundred Fifty-One and 50/100 Dollars ($22,451.50), with interest from October 24, 2014, and costs, along with such other relief as the Court may deem appropriate. A third load of water was added to pool and winter chemicals have been added. Be sure the overflow pipe is open and able to drain any excess water should it be needed. Charlie, the electrician has been notified that he now can do the final electrical hook up. Final township inspection can be requested after electrical and fencing install is complete. Give us a call in the spring and NPS will come out to start up the pool and do the training.
