I, JOHN L. SISTO, of Mechanicsburg, Cumberland County,
Pennsylvania, make, publish and declare this as and for my Last
Will and Testament, hereby revoking all other Wills and Codicils
heretofore made by me.
FIRST: I give and devise any and all interest that I
have in certain real estate owned by me, same being known and
numbered as 23 Fieldcrest Drive, Mechanicsburg, Cumberland
County, Pennsylvania, together with the furniture, furnishings,
household articles and personal effects and other tangible
personal property (not including and excepting, however, all
cash, securities, bank accounts, certificates of deposit and like
intangible personal property), along with the motor vehicle owned
by me at the date of my death, to my son, JOHN L. SISTO, II,
provided, however, that should he predecease me, then to his
issue per stirpes by representation as set forth hereinbelow.
SECOND: I devise and bequeath all the rest, residue and
remainder of my estate of whatever nature and wherever situate,
including any property over which I hold power of appointment and
together with any insurance policies thereon, in equal shares, to
my grandchildren, ANNE K. SISTO and THOMAS J. SISTO, provided
that should either of my grandchildren predecease me, then I
devise and bequeath said grandchild's share unto my surviving
grandchild as set forth herein.
THIRD• Should any of my grandchildren not have at-
tained the age of twenty-five (25) years at the time for distri-
bution to him or her, I give, devise and bequeath the share of
each such grandchild to my hereinafter named Trustee or Trustees,
IN SEPARATE TRUSTS, to hold, manage, invest and reinvest the

portion of income and principal for the said grandchild's post-
high school education (including college, trade school or other
similar training or education), as my Trustee or Trustees, in
their sole discretion, deem advisable. The Trustee or Trustees,
in exercising their discretionary authority with respect to the
payment of income or principal of the within Trust to my
grandchildren, shall take into consideration any income or other
resources available to my grandchildren from sources outside this
Trust.
Any income or principal not so applied shall be dis-
tributed to each grandchild when he or she attains the age of
twenty-five (25) years. In the event any of my grandchildren die
prior to the termination of the Trust set forth herein for their
benefit, the interest of my grandchild in said Trust shall cease
with any income and principal passing to my surviving grandchild.
FOURTH: In addition to all powers granted to them by
law and by other provisions of this Will, I give the fiduciaries
acting hereunder the following powers, applicable to all proper-
ty, exercisable without court approval and effective until actual
distribution of all property:
(A) To sell at public or private sale, or to lease,
for any period of time, any real or personal property and to give
options for sales, exchanges or leases, for such prices and upon
such terms (including credit, with or without security) or
conditions as are deemed proper. This includes the power to give
legally sufficient instruments for transfer of the property and
to receive the proceeds of any disposition of it.
(B) To partition, subdivide, or improve real estate
and to enter into agreements concerning the partition, subdivi-
sion, improvement, zoning or management of real estate and to
impose or extinguish restrictions on real estate.
(C) To compromise any claim or controversy and to
-aiaandon any property which is of little or no value.
-- (D) To invest in all forms of property, including

stocks, common trust funds and mortgage investment funds, without
restriction to investments authorized for Pennsylvania fiduci-
aries, as are deemed proper, without regard to any principle of
diversification, risk or productivity.
(E) To exercise any option, right or privilege granted
in insurance policies or in other investments.
(F) To exercise any election or privilege given by the
Federal and other tax laws, including, but not necessarily being
limited to, gersonal income, gift and estate or inheritance tax
laws.
(G) To make distributions to my herein named benefici-
aries in cash or in kind or partly in each.
(H) To borrow money from themselves or others in order
to pay debts, taxes, or estate or trust administration expenses,
to protect or improve any property held under my will, and for
investment purposes.
(I) To select a mode of payment under any qualified
retirement plan (pension plan, profit sharing plan, employee
stock ownership plan, or any other type of qualified plan) to the
extent the plan or the law permits them to do so, and to exercise
any other rights which they may have under the plan, in whatever
manner they consider advisable.
IF FTH: I nominate and appoint my daughter-in-law,
CINDY D. SISTO, as Trustee of the hereinabove described trusts.
I direct that my Trustee or Trustees shall serve without bond and
shall receive fair and reasonable compensation.

SIXTH: I direct that all inheritance, estate, trans-
'° r. fer, succession and death taxes, of any kind whatsoever, which
. ~ may be payable by reason of my death, whether or not with respect
to property passing under this Will, shall be paid out of the

~„~ SEVENTH: All interests hereunder, whether principal or
~`,, come, which are undistributed and in the possession of the
~f' ciaries acting hereunder, even though vested or distribut-

able, shall not be subject to attachment, execution or sequestra-
tion for any debt, contract, obligation or liability of any
beneficiary, and furthermore, shall not be subject to pledge,
assignment, conveyance or anticipation.
EIGHTH: I nominate and appoint JOHN L. SISTO, II,
Executor of this, my Last Will and Testament. In the event of
the death, resignation or inability to serve for any reason
whatsoever of the said JOHN L. SISTO, II, I nominate and appoint
CINDY D. SISTO, Executrix of this, my Last Will and Testament. I
direct that my Executor or Executrix, as the case may be, and
their successors, shall not be required to post security or a
bond for the performance of their duties in any jurisdiction.

surviving spouse is 3% [72 P.S. 9116 (a) (1.1) (i)].

WHEREAS, the said JOHN L. SISTO, by his Last will and Testament,
duly proved and recorded in the Cumberland County Register of
wills Office, Carlisle, Pennsylvania, in Docket Book 21-02-1006,
Letters Testamentary being issued on November 8, 2002, provided,
in pertinent part, as follows:
FOURTH: In addition to all powers granted to them by
law and by other provisions of this Will, I give the fiduciaries
acting hereunder the following powers, applicable to all
property, exercisable without court approval and effective until
actual distribution of all property:
(A) To sell at public or private sale, or to lease,
for any period of time, any real or personal property and to give
options for sales, exchanges or leases, for such prices and upon
such terms (including credit, with or without security) or
conditions as are deemed proper. This includes the power to give
legally sufficient instruments for transfer of the property and
to receive the proceeds of any disposition of it...
EIGHTH: I nominate and appoint JOHN L. SISTO, II,
Executor of this, my Last Will and Testament...
NOW THIS INDENTURE WITNESSETH, that the said party of the first
part, by virtue of the power and authority aforesaid, in said
Will contained, and in consideration of the sum of One Hundred
Twenty-seven Thousand Five Hundred Dollars ($127,500.00) to him
paid by the said party of the second part, at and before the
ensealing and delivery of these presents, the receipt whereof is
hereby acknowledged, has granted, bargained, sold and conveyed,
and does hereby grant, bargain, sell and convey to the said party
of the second part, his heirs and assigns forever:
ALL THAT CERTAIN piece or parcel of land situate in Silver Spring
Township, Cumberland County, Pennsylvania, bounded and described
as follows, to wit:
BEGINNING at a point on the southern side of Fieldcrest Drive at
the dividing line between Lots Nos. C-1 and C-2 as shown on the
hereinafter mentioned plan of lots; thence along said dividing
line between Lots Nos. C-1 and C-2, South 6 degrees 41 minutes 44
seconds East, a distance of 100.00 feet to a point at the
dividing line between Lots Nos. C-1 and C-5 as shown on the said
plan of lots; thence along said dividing line between Lots Nos.
C-1 and C-5, South 76 degrees 52 minutes 30 seconds West, a
distance of 60.30 feet to a point on the eastern side of
Fie1dcrest Drive; thence along said side of Fieldcrest Drive
North 19 degrees West, a distance of 80.00 feet to a point on the
same at the beginning of a curve to the right; thence continuing
along the side of Fieldcrest Drive on a curve to the right having
a radius of 23.57 feet, an arc distance of 42.08 feet to a point
on the southern side of said Fieldcrest Drive; thence along said
southern side of Fieldcrest Drive; North 83 degrees 18 minutes 16
seconds East, a distance of 53.94 feet to a point on the same at
the dividing line between Lots Nos. C-1 and C-2 as shown on the
hereinafter mentioned plan of lots, the place of BEGINNING.
BEING Lot No. C-l as shown on Page 110A of a certain subdivision
plan of lots entitled "Final Subdivision Plan for Westfields" as
recorded in the Cumberland County Recorder of Deeds Office in
Plan Book 54, Page 110 et seq., said plan having been re-recorded
from Plan Book 52, page 139.
HAVING ERECTED THEREON a townhouse style dwelling unit known and
numbered as 23 Fieldcrest Drive, Mechanicsburg, Pennsylvania.
SAID premises are conveyed under and subject, nevertheless, to
all those certain covenants, conditions and restrictions as"more
fully contained in a document entitled "Declarations of
Covenants, Conditions and Restrictions Applicable to 'Westfields'
in Silver Spring Township, Cumberland County, pennsylvania, as
recorded in the Cumberland County Recorder of Deeds Office in
Miscellaneous Book 344, Page 1007, and incorporated herein by
reference thereto.
BEING the same premises which E. Jane Ling, a/k/a Edna Jane Ling,
single person, by deed dated October 5, 1995 and recorded
December 15, 1995 in the Cumberland County Recorder of Deeds
Office in Deed Book 132, Page 817, granted and conveyed unto
John L. Sisto, single person. The said John L. Sisto died
October 22, 2002.
TOGETHER with all and singular the rights, liberties, privileges,
hereditaments and appurtenances whatsoever thereunto belonging or
in anywise appertaining, and the reversions and remainders,
rents, issues and profits thereof, and all the estate, right,
title, interest, property, claim and demand whatsoever of the
said JOHN L. SISTO at and immediately before the time of his
decease, in law or equity or otherwise howsoever, of, in, to or
out of the same:
TO HAVE AND TO HOLD the said granted premises to the said party
of the second part, his heirs and assigns forever.
AND the said party of the first part, does covenant, promise,
grant and agree, to and with the said party of the second part,
his heirs and assigns, by these presents, that the said party of
the first part, has not done, committed, or knowingly or
willingly suffered to be done, any act, matter or thing what-
soever, whereby the premises aforesaid, or any part thereof, is,
are, shall or may be charged or encumbered, in title, charge or
estate, or otherwise howsoever.

heretofore made by me.
FIRST: I give and devise any and all interest that I
have in certain real estate owned by me, same being known and
numbered as 23 Fieldcrest Drive, Mechanicsburg, Cumberland
County, Pennsylvania, together with the furniture, furnishings,
household articles and personal effects and other tangible
personal property (not including and excepting, however, all
cash, securities, bank accounts, certificates of deposit and like
intangible personal property), along with the motor vehicle owned
by me at the date of my death, to my son, JOfu~ L. SISTO, II,
provided, however, that should he predecease me, then to his
issue per stirpes by representation as set forth hereinbelow.
SECOND: I devise and bequeath all the rest, residue and
remainder of my estate of whatever nature and wherever situate,
including any property over which I hold power of appoint~ent and
together with any insurance policies thereon, in equal shares, to
my grandchildren, ~~NE K. SISTO and THO~~S J. SISTO, provided
that should either of my grandchildren predecease me, then I
devise and bequeath said grandchild's share unto my surliving
grandchild as set forth herein.
THIRD: Should any of my grandchildren not have at-

~ tained the age of twenty-five (25) years at the ti~e for distri-
~ bution to him or her, I give, devise and bequeath the share of
each such grandchild to my hereinafter named Trustee or Trustees,
IN SEPARATE TRUSTS, to hold, manage, invest and reinvest the

shares so received, and to use and apply from time to ti~e such

portion of income and principal for the said grandchild's post-
high school education (including college, trade school or other
similar training or education), as my Trustee or Trustees, in
their sole discretion, deem advisable. The Trustee or Trustees,
in exercising their discretionary authority with respect to the
payment of income or principal of the within Trust to my
grandchildren, shall take into consideration any income or other
resources available to my grandchildren from sources outside this
Trust.
Any income or principal not so applied shall be dis-
tributed to each grandchild when he or she attains the age of
twenty-five (25) years. In the event any of my grandchildren die
prior to the te~ination of the Trust set forth herein for their
benefit, the interest of my grandchild in said Trust shall cease
with any income and principal passing to my surviving grandchild.
FOURT~: In addition to all powers granted to them by
law and by other provisions of this Will, I give the fiduciaries
acting hereunder the following powers, applicable to all proper-
ty, exer~isable without court approval and effective until actual
distribution of all property:
(A) To sell at public or private sale, cr to lease,
for any period of time, any real or personal property and to give
options for sales, exchanges or leases, for such prices and upon
such te~s (including credit, with or withcut security) or
conditions as are deemed proper. This includes the pcwer to give

legally suffi~ient instruments for transfer of the property and

(3) To partition, subdivide, or improve real estate
~ and to enter into agreements concerning the partition, subdivi-

impose or extinguish restrictions on real estate.
(e) To compromise any claim or controversy and to

(D) To invest in all fo~s of property, including

restriction to investments authorized for Pennsylvania fiduci-
aries, as are deemed proper, without regard to any principle of
diversification, risk or productivity.
(E) To exercise any option, right or privilege granted
in insurance policies or in other investments.
(F) To exercise any election or privilege given by the
Federal and other tax laws, including, but not necessarily being
limited to, personal income, gift and estate or inheritance tax
laws.
(G) To make distributions to my herein named benefici-
aries in cash or in kind or partly in each.
(H) To borrow money from themselves or others in order
to pay debts, taxes, or estate or trust administration expenses,
to protect or improve any property held under my will, and for
investment purposes.

CINDY D. SISTO, Executrix of this, my Last will and Testament. I
direct that my Executor or Executrix, as the case may be, and
their successors, shall not be required to post security or a
bond for the performance of their duties in any jurisdiction.
