The Cumberland County Tax Claim Bureau, by its attorney, Keith O. Brenneman,
Cumberland County Solicitor, files this Petition for Rule for Judicial Sale, as follows:
1. Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S.
§5860.101, et seq.
2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents
as follows:
a. Tax claim upon which the property was exposed for sale: 2012 and
2013 Cumberland County, Library and Carlisle Borough real estate
taxes and 2012-13 and 2013-14 Carlisle Area School real estate
taxes. Total amount of taxes, including penalty, interest, and cost as
of date of tax sale: $6,868.38.
b. Neither the owner, his, her, their, or its heirs, successors, assigns, or
legal representatives, or any lien creditor, or his, her, their or its
heirs, successors or legal representatives, or any other person
interested, has caused discharge of tax claim or removal from tax
sale.
c. The property was exposed to public sale pursuant to 72 P.S.
§5860.601 on: September 25, 2014.
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. §5860.605, which upset
price was $12,979.07.
e. Your Petitioner, the Bureau, was unable to obtain a bid at the public
sale sufficient to pay the said upset price.

3. Attached hereto, marked Exhibit "A," and incorporated herein by
reference as if fully set forth herein, is a copy of a title report received
from a title searcher retained by the Bureau together with a copy of the
most recent deed for the subject premises, as of the date of the
search. The tax parcel number of the property is 03-21-0318-040.
The property is situate in the, Borough of Carlisle, Cumberland County,
Pennsylvania and is known as 202 E High Street.
4. The names and addresses of known parties holding tax and municipal
claims, liens, mortgages, ground rents, charges and estates against
the property are as follows:

Delinquent taxes as of February 1, 2015: $10,383.54
(Includes 2012, 2013 and 2014 county/municipal real estate taxes

must be satisfied to stay Judicial sale.

Commonwealth as evidenced in email attached at Exhibit "B".
Satisfaction was not filed with Prothonotary.
Commonwealth Lien filed in the Cumberland County Office of the
Prothonotary on October 21, 2009 as case number 2009-7251 in
the amount of $1,764.10. Lien was paid to Commonwealth with
proceeds from a prior sale with check no. 907271 as evidenced on
email and copy of check attached as Exhibit "C". Satisfaction was
not filed with Prothonotary.
Commonwealth Lien filed in the Cumberland County Office of the
Prothonotary on June 16, 2010 as case number 2010-3997 in the
amount of $9,919.00. Lien was paid to Commonwealth with
proceeds from a prior sale with check no. 907270 also a Corporate
Tax Lien was included in said check as evidenced on email
attached as Exhibit "C" and copy of check attached as Exhibit "D".
Satisfaction was not filed with Prothonotary.
Commonwealth Lien filed in the Cumberland County Office of the
Prothonotary on January 19, 2011 as case number 2011-0434 in
the amount of $1,700.98. Lien was paid to Commonwealth with
proceeds from a prior sale with check no. 907271 as evidenced on
email and copy of check attached as Exhibit "C". Satisfaction was
not filed with Prothonotary.

Exhibit "E". Satisfaction was not filed with Prothonotary.

amount filed.
5. The last known address of the owner of the property as set forth in the
assessment records of Cumberland County is: Dauphin Oil Company
Inc, c\o J.W. Rutledge, 3057 Grasmere Avenue, Pittsburgh, PA
15216. Certified mail sent to said address was signed by
Respondent.

WHEREFORE, Your Petitioner prays your Honorable Court to grant a rule upon
all interested parties, including those listed at paragraphs four and five of the within
Petition, to show cause why a decree should not be made that the property be sold,
freed and cleared of tax and municipal claims, liens, mortgages, charges and estates,
except separately taxed ground rents, pursuant to Section 612 of the Real Estate Tax
Sale Law. 72 P.S. §5860.612(a).

Our records indicate that the sales tax lien (06-4912) has been satisfied. It is possible that the taxpayer did not take a
copy of the satisfaction notice to the prothonotary's office to have it marked as satisfied on their records.
The employer tax lien (09 -7251 -CIVIL ) stands and has a balance due as of 7/10/14 of 1,784.63 plus the lien fee of
$27.50. /i a JA 2L. 27.50
The corporation tax balance due is $25,282.80. There may not be a paper lien in the prothonotary's office due to the
fact that corporation tax liens have automatic statutory liens.

Hi Lora,
In October of 2013 the Cumberland County Tax Claim Bureau sent a check to the Bureau of
Compliance to satisfy two liens on a property that the Tax Claim Bureau sold at tax sale. To date,
these liens are not satisfied in the Cumberland County Prothonotarys office. We have sold another
property owned by the same taxpayer and need to make distribution on the rest of the
Commonwealth liens, but cannot do so until our title search shows that the previous liens were
satisfied.
Attached please find copies of the liens and the check that was sent and cashed by the
Bureau of Compliance. The check was a little more than what was due on the liens, which would
probably account for satisfaction fees. Please look into this matter and either satisfy the liens or if the
check was not enough show the current figure due.
