KEELEY, INC., Defendant/Owner COMPLAINT IN ENFORCEMENT OF MECHANICS' LIEN o Arney Bros., Inc., by and through its undersigned counsel, files the following Complaint in Enforcement of Mechanics' Lien: 1. Plaintiff/Claimant is Arney Bros., Inc. ("Arney"), which has a principal place of business at 4820 Cumberland Street, Harrisburg, PA 17111. Arney files this Complaint as a Contractor. 2. Defendant/Owner of the real estate against which this Complaint is filed is William D. Keeley, Inc. ("Keeley"), 512 Partridge Court, Mechanicsburg, PA 17050. 3. Arney contracted with Keeley to provide certain labor and materials for a townhouse project being constructed by Keeley. 4. The labor and materials supplied by Arney was pursuant to a Proposal dated April 3, 2012, a copy of which is attached hereto as Exhibit 1. 5. Keeley orally accepted the Proposal and instructed Arney to proceed with the work as set forth on the Proposal. 6. The general nature of the labor and material supplied by Arney is described on the Proposal and Statement dated June 14, 2012, a copy of which is attached hereto as Exhibit 2. The labor and materials involved the installation of drain 1 piping from the buildings to a catch basin and the performance of paving in the disturbed area behind the buildings in conjunction with the construction of a four unit townhouse/condominium known as 9, 10, 11, and 12 Westover Drive, Mechanicsburg, PA 17055. 7. The prices charged for the labor and material are as stated on the Statement attached as Exhibit 2, and total $12,552.20. Keeley has paid $3,000, leaving a balance due of $9,552.20. 8. Arney has completely performed all obligations required of it under the Proposal and the balance of$9,552.20 is currently due and owing. 9. The last day Arney supplied labor and/or material was June 14, 2012. 10. The real property subject to the lien is situate in Hampden Township, Cumberland County, Pennsylvania, known as 10, 11 and 12 Westover Drive, Mechanicsburg, Pennsylvania, as shown on a plan of lots entitled The Village of Westover (East Section) Phases V and VI, as recorded in Cumberland County, Pennsylvania Plan Book 60, page 74. A copy of said Plan is attached and made a part hereof as Exhibit 3. 11. On November 30, 2012, Arney filed a Mechanic's Lien Claim against Keeley's property, docketed as Arney v. Keeley, Court of Common Pleas of Cumberland County, No. 12-7252. A true and correct copy of Arney's Mechanic's Lien Claim is incorporated herein by reference and attached hereto as Exhibit "4". 12. Arney is entitled to a judgment against Keeley's property in the amount of $9,552.20, and is entitled to recover such amount from the sale of the above described Property, subject only to senior claims to the above described Property 2 WHEREFORE, Plaintiff/Claimant Arney Bros., Inc., demands judgment against Keeley's property at 10, 11 and 12 Westover Drive, Mechanicsburg, PA 17055 in the total sum of $9,552.20.
