Bank of America,N.A., Successor By Merger to BAC Home Loans Servicing,LP FKA Countrywide Home Loans Servicing, LP (hereinafter referred to as "Plaintiff') is an institution conducting business under the Laws of the Commonwealth of Pennsylvania with a principal place of business at the address indicated in the caption above. 2. Upon information and belief, Sergio E. Gonzalez and Tiffany M. Gonzalez(hereinafter referred to as"Defendants") are adult individuals residing at the address indicated in the caption hereof. 3. Sergio E. Gonzalez and Tiffany M. Gonzalez are the Record Owners of the mortgaged property located at 206 Maple Avenue, Camp Hill, PA 17011, (hereinafter the "Property"). A copy of the Legal Description attached hereto as Exhibit"A" and made a part hereof. 14-1671 GONZALEZ 4 4. On August 20,2010, Sergio E. Gonzalez and Tiffany M. Gonzalez executed a Note in the original principal amount of$167,641.00 payable to Bank of America,N.A. in monthly installments with interest thereto at the rate of 4.750 as provided in the Note(hereinafter the"Note"). A copy of the Note is attached hereto as Exhibit`B"and made a part hereof. 5. To secure the aforesaid Note, Sergio E. Gonzalez and Tiffany M. Gonzalez mortgaged to Mortgage Electronic Registration Systems, Inc., As Nominee for Bank of America,N.A. the property which is the subject of this action(hereinafter referred to as"Mortgage"). The Mortgage, dated August 20, 2010,was recorded on September 2, 2010 in the Office of the Recorder of Deeds in Cumberland County in Mortgage Instrument#201024547. A copy of the Mortgage is attached hereto as Exhibit"C" and made a part hereof. 6. Plaintiff, directly or through an agent, has possession of the promissory note. The promissory note has been duly endorsed. 7. Plaintiff is the Mortgagee of record by virtue of the following mergers and/or assignments: a. Mortgage Electronic Registration Systems, Inc.,As Nominee for Bank of America,N.A. To Bank of America,N.A., Successor By Merger to BAC Home Loans Servicing, LP FKA Countrywide Home Loans Servicing,LP recorded on March 13, 2012 in the Office of Recorder of Deeds in Cumberland County in Instrument #201207308. A copy of the Assignment of Mortgage is attached and made a part hereof as Exhibit"D". 8. The Mortgage is now in default due to the failure of Defendant to make payments as they become due and owning. The date of Defendant's default is April 1, 2013. 14-1671 GONZALEZ 4 9. As a result of the default,the following amounts are due: Principal Balance $160,907.30 Interest from 03/01/2013to 11/30/2014 $13,375.32 , Accumulated Late Charges $93.07 Mortgage Insurance Premium $139.04 Bankruptcy Motion for Relief $585.00 Escrow Balance $5,599.54 TOTAL $180,699.27 plus interest from 12/01/2014 at$636.92 per month, costs of suit and attorney's fees. 10. The attorney's fees set forth above are in conformity with the Mortgage documents and Pennsylvania Law, and will be collected in the event of a third party purchase at Sheriff's Sale. If the Mortgage is reinstated prior to the sale,reasonable attorney's fees will be charged. 11. Notice of Intent to Foreclose as set forth in Act of 1974,Notice of Homeowner's Emergency Mortgage Assistance Program pursuant to Act 91 of 1983, as amended in 2008, and Notice of Default as required by the mortgage document, as applicable, have been sent to the Defendants on August 22, 2014.. A copy of the Notice is attached and made a part hereof as Exhibit"E" and made a part hereof. 12. This is an in rem action only against the aforesaid Property.
