DECREE OF THE REGISTER OF WILLS
AND NOW, this 26th day of November, 2014, upon consideration of the Petition for
Grant of Letters filed by Bruce Z. McLanahan, for the above decedent, and submission of
an instrument offered for probate, dated April 21, 2008, and containing modifications, a
hearing was held to determine the validity of the document.
Evidence was presented that Decedent suffered from Alzheimer's disease. While
she seemed to be of sound mind at the execution of her Will on April 21, 2008, the same
cannot be said for the obliterations made to various clauses in the Second paragraph.
These obliterations include the Decedent's initials and the date of 4/21/08. It is highly
improbable that the Decedent would make obliterations on the same date she executed
the Will itself; the pen used for the signature on the Will is different than the pen used to
make the obliterations; and the penmanship of the initials after the obliterations do not
match Decedent's signature. Further, there is no evidence as to when the obliterations
were actually made and state of Decedent's mental capacity at that time. Therefore the
obliterations will be ignored.
IT IS DECREED that the instrument offered for probate as the Last Will and
Testament of the Decedent shall be admitted as originally typewritten and executed
without regard to the obliterations. Further, Letters Testamentary are hereby issued to
Bruce Z. McLanahan. He shall have all the rights and duties of a fiduciary under the laws
of the Commonwealth of Pennsylvania and shall proceed with the administration of this
estate according to law.
