AND NOW, this ~ day of April, 2005, following a hearing, IT IS
ORDERED the settlement in compromise of this action on behalf of minor, Kyle
Stimeling, born February 25, 1991, for $343,000.00, of which $3,000.00 has already.

been paid to Mark and Tammy Stimeling for reimbursement of the minor's medical UJ
expenses that they paid, IS APPROVED. It is ordered that the remaining settlement
proceeds be distributed as follows:
(1) $40,000.00 shall be held in a federally insured account in the name of Mark
Stimeling and Tammy Stimeling, in trust for Kyle Stimeling, and used only to pay an
existing $4,977.08 lien of Blue Cross and any future medical expenses for the treatment
of the injuries sustained by Kyle Stimeling on December 31,2003. Any balance
remaining of this $40,000.00 shall be transferred to Kyle Stimeling upon his eighteenth
birthday.
(2) Mark Stimeling and Tammy Stimeling shall file a certification in this court,
sent to this chambers, that the account has been opened in the manner prescribed.
(3) $300,000.00 shall be placed in a guaranteed structured settlement account,
as set forth in the petition, for Kyle Stimeling which will make the following periodic
payments:
(a) $950.00 per month to Kyle Stimeling, increasing 3% compounding on
an annual basis for LIFE with 30 years guaranteed. First payment will be
on February 25, 2009 and the last guaranteed payment will be made on
0'--
January 25, 2039. Payments will continue thereafter for life.
(b) $20,000.00 to Kyle Stimeling on February 25, 2016.
(c) $65,606.00 to Kyle Stimeling on February 25, 2026.
(d) $100,000.00 to Kyle Stimeling on February 25,2036.
(e) $135,000.00 to Kyle Stimeling on February 25,2046.
(4) Mark Stimeling and Tammy Stimeling are authorized to sign any release
necessary to effectuate this settlement.
