STIPULATION AGAINST LIENS
WHEREAS, DJH Penn Valley Associates Limited Partnership, a Pennsylvania
Limited Partnership of Pennsylvania, is about to execute contemporaneously herewith, a contract
with Classic Communities Corporation, a Pennsylvania Corporation of Dauphin County,
Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN piece or parcel of land situated in Lower Allen Township,
Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point located on the southern right of way line of Lowell Lane at
twenty-five feet (25') from the centerline of the same and being the front property comer with Lot
#91;thence along said right of way with a curve to the left having a radius of four hundred fifty and
zero hundredths feet, an are length of sixty-two and fifty-eight hundredths feet, a bearing of South
sixty degrees fourteen minutes twenty-one seconds East with a distance of sixty-two and fifty-three
hundredths feet (R =450.001, A =62.58', S 60' 14' 21" E - 62.53') to a point on the same and the
front property comer with Lot#89;thence leaving said right of way and along the property line with
said lot, South twenty-five degrees forty-six minutes thirty-eight seconds West a distance of ninety
and sixty hundredths feet(S 25'46'38"W-90.60')to a point on the same,on the northern edge of
a twenty feet (20') wide storm water easement and the rear property comer with Lots#80, #81 and
#89;thence along said easement and the property line with Lot#80,North sixty degrees one mjipte

to a point on the same lines and a rear property corner with Lots #79, #80 and#91; thence leaving
said easement and along the property line with Lot#91,North thirty-three degrees forty-four minutes
forty-one seconds East a distance of ninety and thirty-three hundredths feet(N 33°44'41"E-90.33')
to a point on the same, on the southern right of way line of Lowell Lane, the front property corner
with said lot and the point of BEGINNING.

BEING Lot#90 on a Plan titled"The Heights of Beacon Hill,Final Subdivision Plan
- Phase 2", recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania in Plan Book 82, Page 47 and as revised in Plan Book 84, Page 38.
UNDER AND SUBJECT to a Declaration of Planned Community recorded in the
Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Miscellaneous
Book 675, Page 1092 and all amendments thereto.
ALSO UNDER AND SUBJECT NEVERTHELESS,to all easements,restrictions,
encumbrances and other matters of record or that which a physical inspection or survey of the
premises would reveal.
BEING PART OF THE SAME PREMISES which BHH Partners,a Pennsylvania
General Partnership,by its Attorney-in-Fact, Don E. Haubert, Sr., by deed dated August 22, 2013
and recorded August 23,2013 in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania in Instrument No.: 201328240, granted and conveyed unto DJH Penn Valley
Associates Limited Partnership,� �raPennsylvania Limited Partnership.
NOW,the 7 r day of December,2014,at the time of and immediately before
the execution of the principal contract, and before any authority has been given by the said DJH
Penn Valley Associates Limited Partnership, a Pennsylvania Limited Part* to the said Classic
Communities Corporation, a Pennsylvania Corporation to commence work on the said building,or
purchase materials for the same in consideration of the making of the said contract with Classic
Communities Corporation,a Pennsylvania Corporation and the further consideration of One Dollar,
to Classic Communities Corporation, a Pennsylvania Corporation paid by DJH Penn Valley
Associates Limited Partnership,a Pennsylvania Limited Partnership it is agreed that no lien shall be
filed against the building by the contractor, or any sub-contractor, nor by any of the material men
or workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
