INSTRUMENT OF DISCLAIMER This instrument is made this 13th day of April, 2005', by Eric D. Newcomer, Steven M. Newcomer, and Lisa M. Newcomer (collectively "Disclaimants"). BACKGROUND The circumstances leading up to the execution of this Instrument are as follows: 1. On December 16,2003, Linda V. Wetterau ("Ms. Wetterau"), died intestate, a resident of Dauphin County, Pennsylvania. 2. On December 22, 2003, upon petition filed to No. 1007-2003, the Dauphin County Register of Wills granted Letters of Administration to Ms. Wetterau's sister, Kathleen A. Newcomer ("Mrs. Newcomer"). 3. On July 20, 2004, Mrs. Newcomer died intestate, a resident of Cumberland County, Pennsylvania. 4. Mrs. Newcomer was survived by her husband, Daniel D. Newcomer, and by her children (the "Disclaimants"). 5. Disclaimants were more than 18 years of age at the time of Mrs. Newcomer's death and were and are under no legal incapacity. 6. On August 11, 2004, upon petition filed to No. 1007-2003 (Ms. Wetterau's estate), the Dauphin County Register of wills granted Letters of Administration d.b.n. to Mrs. Newcomer's husband, Daniel D. Newcomer. 7. Concurrently with the filing of this Instrument, Mr. Newcomer is filing a petition with the Cumberland County Register of Wills, requesting that letters of administration be issued to him in connection with Mrs. Newcomer's estate. 8. In order to eliminate the Pennsylvania inheritance taxes that may otherwise be applicable, Disclaimants hereby renounce and disclaim, absolutely and forever, any and all right, title, and interest in and to their respective intestate shares of the estate of their mother, Kathleen A. Newcomer, including, without limitation, Mrs. Newcomer's intestate share of Ms. Wetterau's estate.
