Petitioner is requesting as part of this Petition that Ms. Myer's share will be credited toward her restitution and distributed between remaining heirs. ESTATE OF MARY JANE LINDEMUTH QUESTIONS REQUIRING ADJUDICATION 1. Distribution of Nancy J. (Toribio)Myers' 20%residual share toward restitution payment. Paragraph VI of Decedent's Will provides as follows: "I give,devise and bequeath all the rest,residue and remainder of my property, whether real or personal, wherever situate, including any property over which I may have a power of appointment as follows: TWENTY PERCENT(20%)to my daughter,NANCY J. TORIBIO,per stirpes; EIGHTY PERCENT(80%)to be divided equally among the following,per stirpes: ELLEN CAMP BLOOM,ELWOOD CAMP,JR., DALE LINDEMUTH, RICHARD LINDEMUTH, SALLY LINDEMUTH, ERV LINDEMUTH,JR., CHARLES M. BOUST,ROBERT BOUST, and TIM BOUST." February 25, 2011,Nancy J. (Toribio)Myers plead guilty to theft of the assets of her mother,Mary Jane Lindemuth,while Ms. Myers had been serving as guardian of the estate for her mother. Ms. Myers was ordered to serve.prison time and pay restitution to the estate. The judgment amount was$689,798.43 (a copy of the order and judgment is attached). To date, Ms. Myers has repaid only a very minimal amount of the restitution. As a 20%beneficiary of her mother's residuary estate,Mrs. Myers is scheduled to receive$26,614.66. Because of the theft of her mother's assets, Petitioner believes that it would be unjust for Ms. Myer's to have the benefit of her 20% share of the residuary estate. Instead, Petitioner believes that her 20% residual share should be applied directly toward the outstanding restitution for the benefit of the other nine residual beneficiaries. Petitioner therefore requests an order from this Court that Ms. Myers' 20% share of her mother's residuary estate be distributed to the office of the Cumberland County Clerk of Courts to be applied directly toward the ordered restitution. 2. Disqualify Ms. Myers from Receiving a Share of the Restitution Payments Ms. Myers theft of her mother's assets has caused great harm to the estate and substantially injured the interests of the remaining residual beneficiaries. It would be inequitable,under the circumstances,for her to receive 20%of the restitution payments that she is required to make. Therefore,the Petitioner respectfully requests that this Court disqualify Ms. Myers from receiving a 20% share of the restitution payments to which she would otherwise be entitled as a residual beneficiary,and instead divide her said share of the restitution payments between the remaining 9 residual beneficiaries. The remaining 9 beneficiaries would then receive 100%of all restitution payments as follows: Ellen G. Bloom 11.12% Elwood Camp Jr. 11.11% Dale Lindemuth 11.11% Richard J. Lindemuth 11.11% Sally A.
