Frey, Esquire, attorney for Nickolas J. Mallios and Constantinos J. Mallios, in their individual capacities and as the Executors of the Estate of Vasiliki Mallios, and Ivo V. Otto, III, Esquire, attorney for DeVoe W. Green and Barbara L. Messner, and respectfully state as follows: 1. On October 30, 2014, a Rule to Show Cause was issued upon the Pennsylvania Department of Revenue and on Metro Bank, to show cause why the Petitioners were not entitled to the relief requested. 2. More than twenty (20) days have elapsed since the date of the Rule and neither the Pennsylvania Department of Revenue nor Metro Bank nor any other person has filed a response opposing the requested relief. 3.
