FOX, JR., Defendant DIVORCE COMPLAINT The Plaintiff, Tonya M. Fox, by her attorneys, the Family Law Clinic, sets forth the following cause of action: DIVORCE UNDER 23 Pa.C.S. ~~ 330I(c) & Cd) OF THE DIVORCE CODE 1. Plaintiff is Tonya M. Fox, who currently resides at 611 Mallard Road, Apartment 5, Camp Hill, Cumberland County, Pennsylvania. 2. Defendant is Donald L. Fox, Jr., who is currently incarcerated at Lancaster Coun Prison, 625 East King Street, Lancaster, Lancaster County, Pennsylvania. 3. Plaintiff has been a bona fide resident ofthe Commonwealth for at least six mon s immediately previous to the filing of this Complaint. 4. Plaintiff and Defendant were married on June I, 1998 in Lancaster, Lancaster C ty, Pennsylvania. 5. Plaintiff and Defendant have lived separale and apart since April 9, 1999. 6. A prior action for divorce was filed on February 8, 2000 in Lancaster County, d ket number CI-00-Oll89. The complaint was served on Defendant on February 16,2000. The divorce action was tenninated, due to inactivity, on October 17, 2003. 7. The marriage is irretrievably broken. - 8. Plaintiff has been advised that counseling is available and that Plaintiff may have t e right to request that the court require the parties to participate in counseling.
