Classic Communities Corporation,.-a /lot Pennsylvania Corporation NO. lq- 7�+� Contractor STIPULATION AGAINST LIENS WHEREAS, Upper Allen Partners, L.P., a Pennsylvania Limited Partnership of Pennsylvania,is about to execute contemporaneously herewith,a contract with Classic Communities Corporation, a Pennsylvania Corporation of Dauphin County,Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THESE parcels or tracts of land upon which shall be constructed certain Units being Unit No. T-179; Unit No. T-180; Unit No. T-181; Unit No. T-182; and Unit No. T-183 of Dorset Square, a Townhome Planned Community, located in Upper Allen Township,Cumberland County, Pennsylvania, which Units are, or will be, created pursuant to that certain Declaration of Covenants and Restrictions for Dorset Square, a Townhome Planned Community and Declaration Plats and Plans recorded in the Office of the Cumberland County Recorder of Deeds as Instrument Number 201038890 or in one or more amendments thereto. ?d 13 TOGETHER with any Limited Common Elements appurtenant to the Units,if any, and the percentage interest appurtenant to the Units,all as more particularly set forth in the aforesaid Declaration and Plats and Plans, as last amended. The Community,the Planned Residential Development, the location of the Subject Property, and the Units intended to be constructed thereon are depicted on that certain unrecorded Tentative Plan for Glaize Orchards, A Planned Residential Development, as revised; the Glaize Orchards Stage 1 Final Subdivision and Land Development Plan recorded in Cumberland County Plan Book 88,Page 89;the Winding Hills (Formerly Glaize Orchards)Stage 1 Supplemental Final Subdivision and Land Development Plan recorded in Plan Book 90,Page 92;and the Winding Hills Stage 2 Final Subdivision and Land Development Plan recorded in Plan Book 93, Page 141. NOW,the �l ` day of December,2014,at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Upper Allen Partners, L.P., a Pennsylvania Limited Partnership to the said Classic Communities Corporation, a Pennsylvania Corporation to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Classic Communities Corporation, a Pennsylvania Corporation and the further consideration of One Dollar, to Classic Communities Corporation, a Pennsylvania Corporation paid by Upper Allen Partners, L.P., a Pennsylvania Limited Partnership it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
