COMPLAINT
AND NOW comes the Plaintiffs, James Weaver and Melanie Weaver, by and through
their attorney, Paul A. Kelly, Jr., and complain of the Defendant and in support thereof aver as
follows:
1. Plaintiffs are James Weaver and Melanie Weaver, adult and competent individuals who
reside at 1132 Eureka Avenue, Scranton, Lackawanna County, PA 18504.
2. The Defendant is Marty Joe Henderson, an adult and competent individual who resides
at 310 Sample Bridge Road, Mechanicsburg, Cumberland County, PA 17050.
3. Plaintiffs own a single family residence located at 327 Hogestown Road, Mechanicsburg,
Cumberland County, Pa 17050.
4. In November, 2013, Defendant and Plaintiffs entered into an oral agreement as follows:
A. Defendant will pay One Hundred Dollars ($100.00) per month as rent to reside
in the premises;
B. the Defendant would begin processing loan documents in order to purchase the
home; and
C. Defendant will pay all utilities and keep the premises in the same condition as
when he took possession in November, 2013.
5. At the end of March, 2014, Defendant had not procured financing to complete the
purchase of the real estate and remained in the Plaintiffs' premises despite non-payment of rent.
6. On July 24, 2014, after conducting a hearing, District Judge Kathryn Silcox, Cumberland
County, entered Judgment giving, inter alia, possession of the premises located at 327 Hogestown
Road, Mechanicsburg, PA 17050 to Plaintiffs and evicted Defendant from said premises. A copy
of District Judge Silcox's Judgment is attached hereto as Exhibit "A".
7. At or prior to the time when Defendant was evicted from the premises, Defendant
damaged the premises and otherwise breached the parties' oral agreement by failing to surrender the
leased premises in substantially the same condition in which he leased the premises in that:
A. Failed to pay for sewer services;
B. Failed to replace fuel oil for heating (200 gallons);
C. Damaged vertical blinds needing replacement;
D. Removal of a lawn mower needing replacement;
E. Damages to the living room rod set needing replacement;
F. Damage/removal of the door bell needing replacement;
G. Damage to carpeting needing replacement;
H. Incurring attorneys' fees to prosecute this action; and
I. Incurring filing fees for this action.
8. The fair and reasonable costs of repairing and replacing the items listed in paragraph 7
above and reimbursing Plaintiffs for incurring attorney's fees and costs is Twelve Thousand Dollars
($12,000.00).
9. The parties' oral agreement did not include any security deposit to be held by Plaintiffs.
WHEREFORE, Plaintiffs demand judgment against Defendant in the amount of Twelve
Thousand Dollars ($12,000.00) with interest, for repairs, replacement of personal items and costs
and attorney's fees.
