testate on June 20, 2013;

WHEREAS, letters testamentary for the estate of the said decedent were duly issued on
June 28, 2013, by the Register.of Wills of Cumberland County, Pennsylvania, to DIANNE L.
KOLLAS, Executrix, hereinafter called Personal Representative, for the Estate of BANKS F.
WILLHIDE,Number 2013-00729;
WHEREAS, said personal representative has gathered assets of the Estate of said
decedent in regard to real property, known as 734 West Louther Street, Carlisle, Cumberland
County, Pennsylvania;
WHEREAS, the said personal representative has gathered the assets of the estate of the
said decedent and the assets consisted of personal and real property, as set forth in Exhibit A,
which is the Inheritance Tax Return prepared by the said personal representative, and which is
attached hereto and made a part hereof, and marked Exhibit A;
WHEREAS, said personal representative has previously disbursed the total sum of Two
Hundred Fifty Thousand ($250,000.00) Dollars in one previous Partial Family Settlement
Agreement and Final Release, and that document is hereby incorporated herein by reference ;

NOW THEREFORE, KNOW YE, that we, Dianne L. Kollas, Donna L. McKain, Robie
Mae Willhide through her Power of Attorney Donna L. McKain, Chad Kollas, Mary Kollas
Kennedy, James Kollas, Charles McKain, Kelly McKain, Todd McKain, and Stephen Willhide,
the named heirs of the Estate of BANKS F. WILLHIDE, and being those persons entitled to
inherit under the Will of BANKS F. WILLHIDE, do hereby, each of us, acknowledge that we
authorize the personal representative to disburse an amount of Forty-Three Thousand Five
Hundred Ninety-Five Dollars ($43,595.00) of the remaining assets of this Estate.
AND, each of us do hereby stipulate that in order to avoid the expense and time involved
in the filing of a formal account and schedule of distribution, at this time and for this current
distribution, we each agree that no account is necessary for the current distribution and we do
hereby agree that we consent to the current distribution being made by this final family
settlement agreement without the filing of an account and schedule of distribution at this time,
the same to be with the same force and effect as if they had been filed and confirmed by the
Orphans Court Division of the Court of Common Pleas, Cumberland County Branch.
AND, we stipulate further the following:
1. That the total amount to be distributed in this Final Settlement Agreement
and Final Release is an amount of Forty-Three Thousand Five Hundred Ninety-Five Dollars
($43,595.00).
2.A. That $21,797.50 of the total shall be distributed to Chad Kollas, Mary
Kollas Kennedy, and James Kollas; for equal distribution among Chad Kollas, Mary Kollas
Kennedy, and James Kollas; such that each of them shall receive $7,265.83.

2.13. That $21,797.50 of the total shall be distributed to Charles McKain, Kelly
McKain, Todd McKain, and Stephen Willhide; for equal distribution among Charles McKain,
Kelly McKain, Todd McKain, and Stephen Willhide; such that each of them shall receive
$5,449.37.
3. That Dianne L. Kollas, Donna L. McLain, and Robie Mae Willhide shall
not receive a distribution at this time.
4. That additional expenses of concluding the estate are still outstanding,
including but not limited to: filing this Family Settlement Agreement and Final Release.
5. That the remaining $20.00, or so, left in the Estate checking account is for
payment of costs; namely, the filing fee demanded by the Cumberland County Register of Wills
for this Family Settlement Agreement and Final Release. It is understood that this figure is an
approximation and that this sum could be less or more.
6. This Final Family Settlement Agreement and Final Release may be
executed in counterparts, each of which shall be an original and all of which when taken together
shall constitute a single agreement with the same effect as if the signatures thereto were upon the
same instrument. It is agreed that a photocopy, scan, or FAX copy of a signature may serve as an
original signature.
THEREFORE, we and each of us do hereby remise, release, quitclaim and forever
discharge the said personal representative, her heirs, executors, and administrators and assigns, of
and from the said estate and from all actions, suits, payments, accounts, reckonings, claims and
demands whatsoever for or by reason thereof, or for any other use, matter, cause or thing
whatsoever touching upon the portion of property currently distributed herein, and each of us do

further hereby covenant and agree that should any liability come due to the estate of the said
decedent after the signing of this agreement, we and each of us do hereby covenant and agree
with each other and the aforesaid personal representative that we will contribute pro rata our
share of the estate, as currently distributed herein, to satisfy any and all claims, demands, suits, or
causes of action which may be successfully prosecuted against the said estate or the aforesaid
personal representative after the signing, sealing and delivery of this Final Family Settlement
Agreement and Final Release.
IN WITNESS WHEREOF, and intending to be legally bound, we have hereunto set our
