STIPULATION AGAINST LIENS
WHEREAS, DJH Penn Valley Associates Limited Partnership, a Pennsylvania
Limited Partnership of Pennsylvania, is about to execute contemporaneously herewith, a contract
with Classic Communities Corporation, a Pennsylvania Corporation , of Dauphin County,
Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN piece or parcel of land.situated in Lower Alley Township,
Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point,located on the northeasterly right of way line of Yarmouth
Lane (50 foot wide right of way) said point being a front property comer of Lot 147 and Lot 146;
thence along the boundary line between Lot 147 and Lot 146, North 41 degrees 55 minutes 18
seconds East a distance of 106.00 feet to a point, said point being a rear property comer of Lot 147
and Lot 146 and Lot 136 and Lot 137 of Phase 2; thence along the boundary line between Lot 147
and Lot 136 of Phase 2, South 48 degrees 03 minutes 12 seconds East a distance of 65.36 feet to a
point, said point being a rear property comer of Lot 147 and Lot 148 and Lot 135 and Lot 136 of
Phase 2;thence along the boundary line between Lot 147 and Lot 148,South 43 degrees 43 minutes
30 seconds West a distance of 107.00 feet to a point, said point being a front property comer of Lot
147 and Lot 148 and being on said northeasterly right of way line of Yarmouth Lane;thence along
said northeasterly right of way line of Yarmouth Lane, along a curve to the left having a radius of
1,970.00 feet and an arc distance of 62.00 feet, said arc being subtended by a chord of North 47
degrees 10 minutes 36 seconds West a distance of 62.00 feet, said point being the point of
BEGINNING.
CONTAINING 6,770.56 square feet or 0.155 acres of land.
BEING Lot No. 147 on a Plan titled"The Heights of Beacon Hill,Final Subdivision
Plan Phase 3", recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania in Plan Book 94, Page 67.
UNDER AND SUBJECT to a Declaration of Planned Community recorded in the
Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Miscellaneous
Book 675, Page 1092 and all amendments thereto.
ALSO UNDER AND SUBJECT NEVERTHELESS,to all easements,restrictions,
encumbrances and other matters of record or that which a physical inspection or survey of the
premises would reveal.
BEING PART OF THE SAME PREMISES which BHH Partners,a Pennsylvania
General Partnership, by its Attorney-in-Fact, Don E. Haubert, Sr., by deed dated August 22, 2013
and recorded August 23,2013 in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania in Instrument No.: 201328240, granted and conveyed unto DJH Penn Valley
Associates Limited Partnership, a Pennsylvania Limited Partnership.
NOW,the o L day of December,2014,at the time of and immediately before
the execution of the principal contract,and before any authority has been given by the said DJH Penn
Valley Associates Limited Partnership, a Pennsylvania Limited Partnership to the said Classic
Communities Corporation,a Pennsylvania Corporation to commence work on the said building,or
purchase materials for the same in consideration of the making of the said contract with Classic
Communities Corporation,a Pennsylvania Corporation and the further consideration of One Dollar,
to Classic Communities Corporation, a Pennsylvania Corporation paid by DJH Penn Valley
Associates Limited Partnership,a Pennsylvania Limited Partnership it is agreed that no lien shall be
filed against the building by the contractor,or any sub-contractor,nor by any of the material men or
workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
