Keller, by and through self-representatio Respectfully avers the following: 1. Appellant resides at 711 Drexel Hills Blvd., New Cumberland, Cumberland Count Pennsylvania 17070. 2. The Appellant received a Notice dated March 25, 2005, that as a result of her viol Ion of Vehicle Code Section 3362, Exceeding Maximum Speed,S points were assigned to her driving record, bringing her current point total to 13 points. 3. As a result ofthis violation, the Notice informed the Appellant that she was also i violation of Vehicle Code Section 1539, and as a result her driving privileges were being suspended for a period of 130 days, effective suspension date April 29, 2005 at ]2:0J a.m. true and correct copy ofthe Notice is attached as Exhibit "A". 4. The Appellant submits that this is her first license suspension and as a result is not eligible for a suspension of 130 days per the guidelines detailed in the Pennsylvania Point System. A true and correct copy of the Pennsylvania Point System is attached as Exhibit "8 '. OPINION AND ORDER OF COURT Bayley, J., July 27, 2005:-- By notice dated March 25, 2005, the Department of Transportation suspended the operating privilege of Rachel E. Keller for 130 days purslJant to the Vehicle Code at 75 Pa.C.S. Section 1539. The suspension was based on an accumulation of thirteen points and Keller having previously had her operating privile!~e suspended.' Section 1539 provides: (a) General rule.-When any person's record shows an accumulation of 11 points for more, the department shall suspend the operating privilege of the person as provided in subsection (b). (b) Duration ofsuspension.-The firstsuspension shall be for a period of 5 days for each point, the second suspension shall be for a period of 10 days for each point, the thlird suspension shall be for a period of 15 days for each point and any subsequent suspension shall be for a period of one year. (c) Determination of subsequent suspensions.-Every suspension and revocation under any provi.sion of this subchapter shall be counted in determining whether a s,uspension is a second, third or subsequent suspension. . .. (Emphasis added.) , The assignment of five points for exceeding the speed limit resulted in the accumulation of the thirteen points. Appellant, age 25, has tl1m convictions for exceeding the speed limit and two convictions for violating traffic control signals. 05-2128 CIVIL TERM On July 25, 2005, a hearing was conducted on Keller's appeal from her suspension. She maintains that this is really a first suspension which, under Section 1539(b), should be for 65 days, not 130 days. A certification of appellant's driver license record was admitted into evidence. It shows that, by notice of March 1, 2002, she was assigned four points as a result of her conviction for violating Section 3362 of the Vehicle Code on February 21, 2002. That assignment brought her total points to eight, which required her to take and pass a special written Elxamination within 30 days.' By notice of April 8, 2002, an indefinite suspension was imposed under Section 1538 of the Vehicle Code because of appellant's "failure to comply with the required Special Examination." Appellant's driving privilege was restored effeiCtive May 30, 2002. Appellant maintains that she took and passed the spE!cial examination, and for whatever reason, a computer failed to record it as a passing score. She argues that because her license was restored she assumed that Penn DOT realized their mistake. The record reflects no such realization on the part of Penn DOT. To the contrary, it shows that pursuant to Section 1545 of the Vehicle Code, upon restoring appellant's 2 Section 1538(a) provides: Initial accumulation of six points.-When any person's record for the first time shows as many as six points, the department shall require the person to attend an approved driver improvement school or undergo a special examination and shall so notify the person in writing. Upon satisfactory attendance and completion of the Gourse or upon passing the special examination, two points shall be removed from the person's record. Failure to attend and satisfactorily complete the requirements of driver improvement school shall result in the sllspension of such person's operating privilege for 60 days. Failure to pass the examination shall result in the suspension of the operating privilege until the examination has been satisfactorily completed. (Emphasis added.) -2- 05-2128 CIVIL TERM license after she finally took and passed a special examination, her points were reassigned at five.3 Appellant filed no appeal from the suspension of her operating privilege despite having been informed in the notice of April 8, 2002, that "You have a right to appeal the Department's action to the court of common pleas (Civil Division) within 30 days of the mail date (April 15, 2002) of this notice." This is appellant's second suspension of her operating privilege and the Department was required to suspend her license for 130 days pursuant to Section 1539 of the Vehicle Code. See Commonwealth v. Moran, 159 Pa. Commw. 655 (1993). Accordingly, the following order is entered.
