MICHAEL JOSEPH TRAPOLSI STATE OF TEXAS * KNOW ALL MEN BY THESE PRESENTS : COUNTY OF HARRIS I , MICHAEL JOSEPH TRAPOLSI of HARRIS County , Texas , being of lawful age and of sound and disposing mind and memory and understanding , do hereby make and publish this my Last Will.- and Testament , hereby revoking any and all Wills , Codicils , and any other testamentary instruments that may have been made by me at any time heretofore. I . I direct that my body be buried in a decent manner suitable to my circumstances and condition in life . II . I direct that all my just debts , including all of the expenses of illness , funeral and burial , and all expenses of administration , if any, shall be paid by my Executrix out of my estate as soon as it is reasonably convenient after my death. III . I appoint my beloved wife , SANDRA LOUISE TRAP01_ST hereinafter referred to as my beloved wife as Independent Executrix of this my will and of my estate . If my beloved wife should fail or cease to serve as my Executrix for any reason , then I appoint VICTOR J. TRAPOLSI as Independent Executor of this my will and of my estate . If he should fail or cease to serve for any reasor , then I appoint PAUL S. DODSON Whether or not my estate is indebted to any person , I give unto my Executrix from the date of granting of letter until my estate has been entirely distributed the same rights , powers , authority , privileges and discretion with reference to the control , management v �z.4A Page one of six pages . S . , Texas ) , in addition to all other powers given to Independent Executors by law. Without limiting the generality of the foregoing authorization , I specifically authorize my Executrix to sell all or any part of my estate upon such terms and conditions as my Executrix may deem proper and to partition all of my property of my estate among the benefi - ciaries entitled thereto in such manner as shall be deemed fair and equitable by my Executrix • 0 I direct that no other action shall be had in any court in relation to the settlement of my estate than the probating and re- cording of my last will and the return of any inventory, appraisement and list of claims of my estate. IV . I devise and bequeath my entire estate , of whatsoever nature and wheresoever situated , to my beloved wife to be hers absolutely , if she survives me . If my beloved wife does not survive me but I am survived by one or more of my child (ren) , then I devise and bequeath my entire estate to my Exe- cutor , as trustee, to be managed., held and distributed as provided in the following paragraph. If neither my wife . nor any of my child (ren ) survive me, then I devise and bequeath my entire estate to those persons who .would have been my heirs at law, in accordance with the statutes of descent and distribution in force in Texas at the time of my death if I had died thirty days after the date of my actual death and such persons shall take such property in the same shares or portions in which said persons would take accordinc to the provisions of said statutes of descent and distri - bution with respect to each type of property being distributed . My Executor , as trustee ( hereafter called "my Trustee" ) , shall hold the property devised and bequeathed to him in the preceding Page two of six pages . fie'"s—tator MICAAEL JWEPH TKOOLY paragraph together with all other property coming into my Trustee ' s possession as the result of my death ( including all insurance on my life and employee death benefits ) in trust until there are none of my child (ren ) living and under the age of eighteen ( 18 ) years of age , at which time the trust shall terminate and all remaining trust property shall be distributed to my then living child (ren ) , per stirpes , and not per capita ; or if none of my child (ren ) are then living , my Trustee shall distribute all remaining trust property to those persons then living who would have been my heirs at law , according to the statutes of descent and distribution then in force in Texas if I had died at the time provided for termination of the trust, in the same share or portions in which said persons would take according to the provisions of said statutes of descent and distri - bution with respect to each type of property being distributed . Until the termination of the trust, my Trustee may accumulate all or any part of income thereof , or may pay or expend any part or all of the income thereof or any part or all of the principal thereof for the reasonable care, support, maintenance , education or comfort of any of my child (ren ) in its absolute discretion , not necessarily equally , but according to their needs or any other standard which my Trustee may deem appropriate . No interest of any of my child (ren ) in a trust arising under this will shall be subject to anticipation or voluntary or involuntary alienation , nor shall any payments received directly by my Trustee as the result of my death ( including all payments re- ceived from insurance on my life or employees death benefits ) be liable for any inheritance , estate , succession or other death taxes or any debts of my •estate. As to any distribution made in accordance with the provisions hereof , my Trustee may in its discretion make such distribution to any such person in any one or more of the fol - lowing ways : ' ( 1 ) to any such person directly ; . ( 2) to the guardian', committee , conservator , or other similar official of a minor or in- capacitated person; ( 3 ) to a relative of a minor or incapacitated ' Page three of six pages . V . If my beloved wife does not survive me , I appoint PAUL S. DODSON to be Guardian of the person and estate of my child (ren ) who arp under eighteen (18) years of age at the time of my death , without requirement of bond or other security. If said PAUL S. DODSON should fail to serve or continue to serve as Guardian for any reason , then I appoint NANCY L. DODSON to be such Guardian also without requirement of bond or other security . VI . As used in this will , references to "my child (ren) " shall mean DONALD MICHAEL TRAPOLSI DAVID JOSEPH TRAPOLSI and any other child (ren) hereafter born to or adopted by me . For the purposes of this will , no person shall be deemed to have survived me if such person dies within thirty days of my death . VII . My beloved wife and I may at approximately the same time execute similar wills in which each of us is the recipient of the other ' s bounty to a greater or lesser extent; however , these wills are not the result of any contract or agreement between us and either will may be revoked or amended at any time at the sole dis- cretion of the maker thereof.
