MOTION TO WITHDRAW PETITION FOR APPOINTMENT OF
PLENARY GUARDIAN OF THE PERSON AND
ESTATE IN ACCORDANCE WITH 20 Pa.C.S.A. § 5511
Petitioner Cumberland County Aging and Community Services, by its attorney,
Cumberland County Assistant Solicitor Jennifer B. Hipp, submits this Motion to Withdraw
Petition for Appointment of Plenary Guardian of the Person and Estate of Lyle D. Massie in
Accordance with 20 Pa.C.S.A. § 5511 and in support thereof states the following:
1. Petitioner is Cumberland County Aging and Community Services, having an office
located at 1100 Claremont Road, Carlisle, Pennsylvania.
2. Petitioner filed a Petition for Appointment of Plenary Guardian of the Person and
Estate of Lyle D. Massie in Accordance with 20 Pa.C.S.A. § 5511 on December 16,
2014, for which this Honorable Court scheduled a hearing on January 21, 2015 at
1:30 p.m.

3. Lyle D. Massie passed away on or about January 9, 2015.
4. Given that Mr. Massie is passed away, Petitioner no longer seeks to become his
plenary guardian and seeks to withdraw its Petition for Appointment of Plenary
Guardian of the Person and Estate of Lyle D. Massie in Accordance with 20
Pa.C.S.A. § 5511.
5. Petitioner respectfully requests that this Honorable Court grant its Motion to
Withdraw its Petition for Appointment of Plenary Guardian of the Person and Estate
of Lyle D. Massie.
6. Susan D. Hartman, Esquire, attorney for Lyle D. Massie, supports this Motion.
WHEREFORE, Petitioner Cumberland County Aging and Community Services
respectfully requests that this Honorable Court issue an Order approving its Motion to Withdraw
its Petition for Appointment of Plenary Guardian of the Person and Estate of Lyle D. Massie in
Accordance with 20 Pa.C.S.A. § 551 l.
