requiring adjudication as discussed in item 4 above has been or will be given to all
persons affected thereby.

CUSTODY STIPULATION AND AGREEMENT
AND NOW,this,-! day of August,2011,the Plaintiff,Betsy J. Suggs, (hereinafter
referred to as"Maternal Aunt"),and the Defendants, Connie L Royer,Robert P.Royer,
(hereinafter referred to as"Maternal Grandparents"), and Kathy Jean Irvin, (hereinafter referred
to as"Paternal Aunt");having reached.an agreement regarding custody and the best interest and
welfare of the minor child,it is hereby ORDERED and DECREED as follows:
WHEREAS,Plaintiff,Betsy J. Suggs,is the Maternal Aunt of the minor child;
Defendants, Connie L. Royer and Robert P.Royer are the Maternal Grandparents and Defendant,
Kathy Jean Irvin,is the Paternal Aunt of the minor child,namely,Brandon V. Liddick,born
November 6,2003, (hereinafter referred to as"child");and
WHEREAS,the child's natural mother,Wendy K.Royer,and the child's natural father,
Robert A. Liddick,both died on June 15,2011; and
WHEREAS,pursuant to this Court's Order dated July 26,2011,Maternal Aunt was
appointed Guardian of the Person and of the Estate of the Minor Child; and
WHEREAS,the parties have reached an agreement as to the best interest and welfare of
the child, the terms of which agreement they desire to set forth in the present Custody Stipulation
and Agreement; and

WHEREAS,the parties desire the provisions of the present Custody Stipulation and
Agreement be approved by your Honorable Court and entered as a Court Order with the same
force and effect as though said Order had been entered after Petition,notice and hearing.
NOW, THEREFORE,the parties mutually agree as follows:
1. Legal Custody. Maternal Aunt shall have sole legal custody of Brandon V.
Liddick,born November.6,2003. The parties agree that major decisions concerning the child,
including,but not necessarily limited to,the child's health,welfare, education,religious training
and upbringing shall be made by Maternal Aunt,with a view toward obtaining and following a
harmonious policy in the child's best interest. Maternal Aunt agrees not to attempt to alienate
the affection of the child from the other parties. Day to day decisions and any emergency
decisions shall be the responsibility of the Maternal Aunt, as well as any enrollment or
termination in a particular school or school program, advancing or holding the child back in
school,authorizing enrollment in college,authorizing the child's driver's license or purchase of
an automobile, authorizing employment, authorizing the child's marriage or enlistment in the
armed forces,authorizing foreign travel,passport application or exchange student status. The
parties agree that Maternal Aunt is awarded sole legal custody in order to afford her the role as if
she were the natural parent'.
2. Physical Custody: Maternal Aunt shall be awarded sole physical custody of the
child.
3. Family Relationships: The parties acknowledge the minor child has formed a
positive bond with Paternal Aunt and Maternal Grandparents,as well as other relatives. Maternal "
Aunt agrees not to attempt to alienate the affections of the child from the other.parties and other
relatives and will make a special conscious effort not to do so. Each of the parties and any third

party in the presence of the child shall take all measures deemed advisable to foster feelings or
affection between the child and the child's grandparents and other relatives. The parties shall not
do,or say,nor shall either party permit any third person to do or say,anything which may estrange
the child from the other parry,their relatives or injure the child's opinion of the child's grandparents
or which may hamper the free and natural development of the child's love and respect for his
relatives. Maternal Aunt agrees to consult with any counselor or therapist for the child in order to
appropriately communicate with the child regarding the death of the child's natural parents.
Maternal Aunt shall support the child's'access to all family relationships. Special family events
such as weddings,family reunions,family gatherings, funerals,graduations,etc. are encouraged to
be accommodated by Maternal Aunt.
4. Modification of f Agreement: The parties are free to modify the terms of this
Agreement,but in order to do se,all parties must be in complete agreement to any new terms. All
agreements to modify must be planed in,writing and executed by all parties to be effective.
5. Legal Representation: Maternal Aunt has been represented by John J.Connelly,
Jr.,Esquire,Christine Taylor Brann,Esquire,and the law firm of James, Smith,Dietterick&
Connelly, LLP. Maternal Grandparents and Paternal Aunt have been advised of their right to
have representation by counsel of their choice and have been afforded the opportunity to obtain
their own counsel,but have elected to proceed,pro se.
6. Incorporation into Order: The parties agree that this Stipulation and Agreement
shall be incorporated into an Order of Court which will be binding upon the parties as if issued,after
a full.hearing on the merits.
